The CNIL asks the government for evidence on the effectiveness of the health pass

In his fourth opinion, issued Tuesday, November 30, the personal data gendarme deplores the lack of data provided by the government to assess the device.


The National Commission for Informatics and Liberties (Cnil) is starting to lose patience.

After eighteen months of pandemic, the gendarme of personal data issued Tuesday, November 30 a fourth opinion on the systems to fight against Covid-19.

Although addressed to Parliament, the text this time directly challenges the government on the need to provide guarantees as to the concrete effectiveness of the health pass, in place since June 9, 2021 in France.

The Commission's report mentions 42 controls of the various systems put in place since March 2020, including around ten controls since last summer. It underlines the lack of data communicated by the government around the health pass. "

The CNIL insists on the need that the elements which make it possible to assess the effectiveness of the aforementioned treatments be quickly transmitted to it, in order to continue the exercise of its mission

", she writes in her opinion. The latter also deplores that "

despite several requests

" since September 2021

such an assessment has not, to date, been sent to the Cnil

In this regard, she recalls that “

the use of the aforementioned devices remains conditional on guarantees relating to their effectiveness

”.

Supported by the scientific council on multiple occasions, the establishment of the health pass as the main measure in France to fight against the virus has, for the moment, not been the subject of quantitative analysis.

Indeed, the Ministry of Health does not dedicate any data set to provide visibility on its effectiveness.

Since the implementation of the device and its various evolutions, the executive especially emphasizes the massive increases in vaccination.

A phenomenon observed again since the speech last Thursday by the Minister of Health, Olivier Véran, announcing the need for a third dose of vaccine to maintain the health pass after January 15, 2022.

In recent months, the introduction of the health pass has also given rise to numerous frauds.

Citizens present in particular false health passes, claiming to have been vaccinated.

Trafficking has also been revealed by many media, mainly with the sale by individuals of forged documents.

Protection of personal data

Beyond the issue of the health pass, the CNIL also recalls in its opinion the shortcomings with regard to the security of personal data of users of the TousAntiCovid application.

It notes, however, that "

the Ministry of Solidarity and Health has put in place new methods to reduce the risk of malicious exploitation of the data collected

".

The Commission has also announced a fifth phase of control,

"relating to the retention period, deletion and / or anonymization of data"

on the various measures to combat Covid-19.

This new control phase is scheduled for the end of 2021, and the results will be communicated in its next opinion.

Since the summer, the CNIL has repeatedly recalled the need for the emergency measures put in place by the executive to be limited in time, so as not to become an obstacle to individual freedoms.

And to be able to delete

"as soon as possible"

all the personal data of French citizens used for these documents.
