A German court yesterday (Tuesday) sentenced a former ISIS fighter convicted of involvement in genocide and crimes against humanity against the Yazidi minority in Iraq and Syria, including the murder of a five-year-old girl. This is a precedent-setting ruling regarding the genocide committed by ISIS while it controlled large parts of Iraq and Syria from 2014 until its territorial defeat in the international coalition attacks in 2019.
A court in Frankfurt has convicted 29-year-old Taha al-Jumaili of involvement in the massacre of more than 3,000 Yazidis and the enslavement of 7,000 women and girls by members of the jihadist organization between 2014 and 2015. His crimes included the murder of a five-year-old Yazidi who was handcuffed to a window and allowed to die in the scorching heat of Iraq in 2015.
Al-Jumaili, who entered the court while covering his face with a folder of documents, was arrested in Greece in 2019 and extradited to Germany, where relatives of Yazidi victims joined the legal proceedings against him.
In October, his German wife was convicted of involvement in enslaving the same Yazidi girl and mother, and she was sent to ten years in prison, but she testified against her husband as a witness to the prosecution.
"Today's ruling marks the first ever global confirmation by any court that Islamic State's crimes against the Yazidis are genocide," said Mika Olszak of the German branch of Amnesty International.
Germany has prosecuted several German and foreign citizens for war crimes and crimes against humanity committed outside the country, using a universal judicial law that allows serious crimes to be prosecuted even if they were committed in a foreign country.
