The Mexican youtuber YosStop was released from prison on Tuesday after the Prosecutor's Office agreed to reclassify her previous accusation of a crime of child pornography to one of discrimination, her lawyer said in a press release.

The youtuber, whose real name is Yoselinne Hoffman Badui, had been in preventive detention since June 29.

Ricardo Cajal, lawyer for YosStop, said that the reclassification of the crime by the Attorney General's Office of Mexico City allowed the defense to file a request for conditional suspension of the process, which was "promptly reviewed and authorized by a judge "According to the statement. That change was what allowed Hoffman Badui to be released, the lawyer said.

According to the Prosecutor's Office, "the conditional suspension of the criminal process" that the "influencer" faces was authorized for three years.

Hoffman Badui was not convicted or sentenced for the crime of child pornography.

Upon his release from prison on Tuesday night, YosStop told reporters he was "happy because I am now free."

The details of the agreement reached by "YosStop"

According to the Mexican authorities, several lawyers filed a complaint on March 3 against the youtuber, stating that she had acquired, stored, reproduced and publicized a sexual video recording of a minor.

The plaintiff's lawyers presented as evidence a video entitled "Pathetic Generation" that Yoselinne Hoffman uploaded to YouTube and in which she claims to have another video with sexual content.

YosStop's defense said that "the parties at all times privileged the pedagogical potential of the present case" after having a rapprochement with both the victim and their lawyers in order to "achieve comprehensive reparation ... seeking a transformative approach and attending to the gender perspective ".

The Prosecutor's Office reported this Tuesday that YosStop adhered to a restorative justice agreement, which consists of granting it "various material goods, the payment of an economic amount, not contacting the victim, a public apology, as well as not expressing itself in a degrading way, insulting and humiliating towards any person ".

They must also publish a video every month to share the content of the courses they must attend after the agreement, they must be trained on the subject of victims and donate 5% of their income to victims' associations or groups, reported the Prosecutor's Office.
