The municipality of Ottenhofen is filing a lawsuit against a building permit from the Erding District Office.

There are two construction projects in Herdweg for which the development has not been clarified.

Ottenfhofen

- "We have been driven through the streets by the district office for years and put up against the wall," complained at the latest meeting of the local councilor Alfred Greckl (FWO).

The municipality is filing a lawsuit against a building permit from the higher-level authority.

The stumbling block is a building project on Quellenweg and Moosweg in Herdweg.

In December 2018, the Erding District Office complained that the development was not secured here.

Now the same authority wants to approve the construction project.

In contrast, the Ottenhofen community refused to give its consent and cited this lack of development, which the District Office complained about, as a reason.

Greckl emphasized that it should not be that the community is always portrayed as the blocker.

The district office accompanies the community in the ongoing construction management procedure, where it is precisely this production of a development that is at stake.

Andreas Lippacher (FWO) complained that the district office had declared Herdweg to be indoor.

That is what brought about this situation, said Lippacher.

In the interior, there are stricter requirements for secure access than in the exterior.

If the district office now gives its consent despite the opposing letters from the same authority, the municipality can take legal action.

A complaint by the municipality against the building inspectorate approval of a project has no suspensive effect.

In principle, the client can start with the building project.

The letter from the district office that this area is not sufficiently developed would then be an issue in court.

The council got tough on how to deal with this now.

Mayor Nicole Schley (SPD) scolded: “It's a hitch.

One says so, the other says so. "

If a court now says that the arguments of the district office of an unsecured development are wrong, Ottenhofen could possibly have saved himself the entire construction control procedure.

"We are drawing up a development plan for an insane amount of money," Lippacher criticized.

In a letter from District Administrator Martin Bayerstorfer (CSU) dated November 2018, it was said that the development in Moosweg was not sufficient.

The building permit authority is contradicting this.

This contradiction has not yet been clarified.

The municipal council has now decided to file a lawsuit against the preliminary decision issued by the Erding district office in Moosweg.

For the building project in Quellenweg, the municipal council has not given the municipal consent within the framework of the renewed participation.

In addition, it was decided that, if the District Office gives its consent, a lawsuit will be filed immediately.

The clear proof that it is too narrow in Moosweg was provided by a fire brigade.

The large vehicles of the Wehr actually had problems getting through.

Deficiencies in the safety of the emergency services have been documented here.
