Six-year-old, the sole survivor of an accident causing the death of his parents, who was kidnapped and taken to Israel by his grandfather, flew to Italy on Friday (December 3rd) after a family dispute concerning his custody.

The child's departure for Italy came after months of dispute between his maternal grandfather Shmulik Peleg, who lives in Israel, and his paternal aunt Aya Biran, who lives in Italy.

The quarrel arose after the accident that killed his parents and his little brother in May when a cable car fell that left a total of 14 dead in Italy, where they were residing.

Kidnapping charges dismissed

The child was taken to Israel in September by Shmulik Peleg, aboard a private jet, during a visitation, after which he was supposed to return the boy to his aunt. Italian justice then opened an investigation for kidnapping. For his part, the maternal grandfather was questioned by the Israeli police. Eitan Biran's maternal family reject kidnapping charges and say the boy's parents wanted him to grow up in Israel.

On October 25, an Israeli court ordered the child's return to Italy and her grandfather's appeal against this decision was dismissed on November 12.

In a last resort, Shmulik Peleg had announced his intention to turn to the Supreme Court, which had frozen the decision before ruling definitively on Monday for the boy's return to Italy.
