Austria is one of the most sought after countries in Western Europe and many Israelis dream of holding an Austrian passport - whether it is because of the great benefits the citizens enjoy, the country's financial strength and the gateway to the EU passport to study and work in EU countries.



To date, obtaining Austrian citizenship has been an almost impossible task, and it seems that Austria is not really interested in granting citizenship or at least piles quite a few difficulties also on the descendants of Austrian citizens, but in September 2020 a sub-section of the Austrian Civil Law enacted in September 2019 came into force. Completely.

The change in the law can also be an opportunity for those who have applied in the past and received a refusal and even if the parents who lived in Austria did not have citizenship, so it is very worthwhile to get to know the changes and also try again.

Big small change

To date, the Austrian Citizenship Law has included many restrictions on obtaining citizenship, but a small subsection changed the picture for Israeli citizens: "The Austrian Citizenship Law does not work on the basis of religion, "The Austrians want to redress this injustice and although they do not explicitly mention Jews in the amendment to the law, the new section states that anyone who escapes from Austria from the terror of the Nazis can obtain citizenship."



The most significant relief is that even descendants of women with Austrian citizenship can obtain citizenship. The General Austrian Citizenship Law has understandable discrimination against women, and states that anyone born before 1983 to an Austrian woman cannot obtain citizenship. The new section has no meaning to the question of whether you are a descendant of a woman, which actually means that women who fled Austria between the years 1933-1945 are entitled to receive citizenship and so are their descendants. "Children, grandchildren, great-grandchildren of an Austrian citizen in those years are entitled to citizenship," says Adv. Lankar.



Another significant relief is that the new section also allows those who are descendants who did not have Austrian citizenship during World War II to obtain citizenship. The amendment is very significant because during the war many Jews from countries that were part of the Austro-Hungarian Empire lived in Austria, such as Hungary, Poland, Ukraine, Romania, the Czech Republic, Slovakia and a small part of Italy and did not have Austrian citizenship.



"Many of the Israelis who approached us in the past did not even know if their parents had Austrian citizenship," says Adv. Lankar. "We would check before starting a process and find that many do not have Austrian citizenship. When the law came in we called everyone and announced that they have an option today to apply. Even those who knew that parents do not have citizenship, today they have the opportunity to apply. "



Another amendment introduced by the new section is that in violation of the Austrian General Citizenship Law, according to which a person who volunteers for a foreign army loses his citizenshipIn the new section there is no such reservation.



Another change is the possibility of holding an unlimited number of citizenships, so that even if you have additional citizenships in addition to Israeli citizenship, it will not affect your ability to obtain Austrian citizenship as well.

"Many Israelis who held American citizenship, for example, gave up applying for Austrian citizenship, but today they do not have to," says Adv. Nir Lankar.
