Legal aid services are an important part of the rule of law in Hong Kong. On average, more than 8,000 civilians are benefited each year to protect their rights.

However, the "Recommended Measures for Improving Hong Kong's Legal Aid System" document submitted by the Office of the Chief Secretary for Administration and its Legal Aid Department to the Legislative Council Committee on Justice and Legal Affairs earlier (October 26) has caused a lot of controversy. It stipulates that unless there are special circumstances, the aided person will no longer be allowed to nominate a lawyer on his own in criminal cases, but a lawyer will be appointed by the Director of Legal Aid.

Some people are worried that this may harm the recipient’s freedom of choice. Others believe that the appointment of a lawyer can better protect the principle of equality for all-which approach is more in line with judicial justice?

Chen Wenmin believes that if the arrangement for the aided person to nominate a lawyer is revoked, the applicant will not even have the opportunity to nominate or object, and he cannot express his free will, which may violate the Basic Law.

Xiong Yunxin pointed out that "legal aid assignment lawyer" is not the same as "exploitation of nominated lawyers", and "nominated lawyers" is not the same as "selecting lawyers."

Gu Minkang, director of the National Hong Kong and Macau Research Association, believes that assigning lawyers can uphold the legal profession.
