Mercy judgment for the Brunner bat: Markus S. (30) does not have to go to prison again - although he consumed drugs several times and violated his conditions after imprisonment.
How the court justifies its judgment.
Markus S. (30) is Dominik Brunner's convicted murderer in 2019
After almost ten years in prison, S. was released in 2019 - albeit under strict conditions
He has violated it several times, but he does not have to go to prison again
Munich - Markus S. (30) rocks back and forth with his angular shoulders. “You don't become a better person in prison,” he says. These are his last words after three and a half hours of negotiation, then the verdict against the Brunner thug, who had to go to court for drug use.
He was threatened with re-imprisonment, but judge Susanne Hemmerich showed mercy.
“Guilty”, she decided
and sentenced S. to a
fine
of 5400 euros. But S. doesn't have to go to jail after all - a real surprise. Because since May 2019 Markus S. had violated his leadership requirements several times - until then he had been
imprisoned for the murder of Dominik Brunner for
a total of nine years and ten months. The judiciary released him in mid-2019 only under strict conditions: until 2024, S. has to wear an electronic ankle bracelet and undergo therapy, and is not allowed to use alcohol or drugs. But he violated it three times - the last time in the summer of 2020, when he was found to have used cocaine twice.

“That would actually have meant imprisonment,” said Hemmerich.
But she praised the
positive life development of Markus S.
, Who left a permanent job and his criminal environment.
"It is not easy when you get out of jail so young after almost ten years," said his defense lawyer Maximilian Pauls - experts had also certified Markus S. a good rehabilitation.
Still, he relapsed.
Munich: Brunner-Schläger was caught with alcohol and drugs
From a purely legal point of view, consumption is not at all punishable, but it constituted a
violation of the management
requirements and thus a criminal offense.
That was particularly sensitive because Markus S. was under open probation.
Because just six weeks after his release from prison, he was caught by the police with alcohol
in June 2019
.
The district court sentenced him to three months in prison in December 2019, but the judge suspended it - he gave S. "one last chance".

Trial in Munich: Markus S. was first given probation, then imprisonment - and now a fine
This was forfeited in May this year: Because of
cocaine consumption
in 2020, the district court pronounced nine months imprisonment, which has now
been collected again
in the
appeal hearing at the district court
.
“You shouldn't get the feeling that everything you built up was pointless,” justified Judge Hemmerich - and showed mercy.
To the relief of Markus S. He said: “
In jail there is only violence
.
Outside I was overwhelmed at first.
But I've learned to come to terms with it.
I just want to lead a normal life now. "
