Natural disasters: Parliament simplifies and strengthens compensation

The new law notably extends the scope of the “natural disasters” guarantee to the costs of emergency rehousing.


Floods, storms, drought ... Parliament definitively adopted Thursday, by a final vote of the Senate, a MoDem bill supported by the government which aims to simplify and strengthen the compensation scheme for natural disasters.

This text, which reforms the so-called “

catnat

regime

, instituted in 1982, provides for more transparency for the procedure for declaring natural disasters by the State, the keystone of the system.

It was voted on for the last time on Monday by the National Assembly.

Among other concrete measures, it revises the various deadlines applicable to compensation by insurers, in the interest of victims.

It extends from 10 to 30 days the period available to the insured to make his claim after the publication of the decision to recognize the state of natural disaster.

The insurer will have a period of one month to make the repairs, or 21 days to pay the compensation due to the insured.

It extends the scope of the “

natural disasters

” guarantee

to include emergency rehousing costs.

One billion euros per year

In the event of land movements resulting from drought or rehydration of the soil, compensation must make it possible to finance repairs effectively putting an end to the existing disorders.

Concerning the communities, the proposed law extends from 18 to 24 months the period available to the municipalities to transmit their request for recognition of the state of natural disaster.

It sets up a "

referent

" at the level of the department, to support elected officials in their procedures.

Finally, it sets up a “

National Advisory Commission on Natural Disasters

” responsible for issuing an annual opinion on the relevance of the criteria used to pronounce the state of natural disaster.
