In Lower Saxony, a court overturned the 2G rule in retail.

Will the measure soon also fall in the Free State?

Some votes are for it.

Now the state government has expressed itself.

Munich - A court in Lower Saxony has declared the 2G rule in retail to be null and void.

The court decided that the measure was not necessary to further contain the coronavirus * and was not compatible with the general principle of equality.

After the judgment, the Bavarian Chamber of Commerce and Industry (BIHK) is calling for Bavaria to end.

“The federal and state governments should end 2G in retail.

All shops should be allowed to open again without restriction - of course with a distance, masks and a hygiene concept ”, BIHK President Klaus Josef Lutz is quoted in a message.

The Bavarian state government sees it differently.

2G rule in retail should remain in place in Bavaria - "We are in the middle of the fourth wave"

Lutz had also criticized the fact that the regulation leads to "disproportionate distortions of competition in stationary retail".

“While basic suppliers are open to all customers, assortment providers are only allowed to open under 2G and with the greatest possible control effort.

And that even though the entire retail trade is not a driver of infection. ”The affected retailers are threatened with livelihood-threatening damage over time.

After the federal government had already announced that it would adhere to the bans on access for unvaccinated people in large parts of the retail trade, the Bavarian Health Minister Klaus Holetschek (CSU) has now also made a statement.

"We are in the middle of the fourth wave of the pandemic, our intensive care units are full," he explained to the German Press Agency in Munich *.

In addition, the Omikron variant is just around the corner and Federal Health Minister Karl Lauterbach (SPD) is already talking about a fifth wave.

Holetschek: "I consider the repeal of 2G rules to be unreasonable"

"In this environment, I think it is unreasonable to demand the lifting of the 2G rules," emphasized Holetschek. For this reason, the Bavarian state government believes that the current 2G / 2G-Plus regulations, including the 2G regulations for retail, are still required in light of the continuing worrying level of infection.

Hubert Aiwanger had previously

reacted cautiously to the planned 2G obligation in retail

in an interview with

.

He is concerned about the economic consequences.

In the BR show "Jetzt red i" on Wednesday evening (December 15), however, he promised easing for Bavaria.

In the retail sector, he advocated that the evidence should only be checked on a random basis, as is already the case in some other federal states.

If there is then a threat of a fine, that would be enough of a deterrent, according to the head of the Free Voters.
