Local councilor Georg Leininger (PFB) accused mayor Fritz Egold of lying in the recent Seeshaupter local council meeting.

The point of contention was whether attorney Michael Böcker was hired by the community as legal advisor.

Both Egold and Böcker deny a mandate.

Seeshaupt

- “Don't lie!

You're lying now ”, were the words of Councilor Georg Leininger (PFB) to Mayor Fritz Egold in the recent Seeshaupter council meeting.

This was preceded by a statement by Egold on the published press articles on the "Causa Bernwieser".

Michael Bernweiser had reported to the newspaper that the public prosecutor had stopped all investigations against him and described himself as "completely rehabilitated".

In his statement, Egold went into the events surrounding the charges against the former Sees-Haupt mayor and emphasized that the community had an "underground external effect" due to the negative reporting.

He asked the local councils for advice and asked whether a lawyer should be consulted.

Andreas Rilk (GrAS), Dorothee von Jungsfeld (CSU) and Reinhard Weber (SPD) agreed in their speeches.

"You are approached by citizens from other communities," said Rilk.

“It's scary.” Weber affirmed: “It has to be over with the private disputes.” One should concentrate on the positive, the community has achieved a lot since Egold took office.

Leininger: "I would have liked more honesty from the mayor"

Then Georg Leininger (PFB) took the floor: "I would have liked more honesty from the mayor." According to Egold, when he took office (we reported) the two had an exchange of blows. "In the documents of the public prosecutor's office it is stated that no specific missing data could be named," said Leininger. Egold explained: “I cannot say that everything was there, I also cannot say what is missing. This is not a lie, but an established fact. "

Leininger referred to a document signed by Egold, from which it emerged that the municipality of

Seeshaupt had hired Michael Böcker as a lawyer. "Here's your signature," said Leininger, holding out a piece of paper. Egold replied that Michael Böcker had said at the citizens' meeting in mid-October that he had no commission from the community. “I'm not the community's lawyer,” Böcker said in front of around 70 citizens. Kathrin Bernwieser, daughter of the former mayor, had previously claimed the opposite - with reference to any evidence.

On Tuesday Egold asked treasurer Hans Jocher whether a fee had been paid to Böcker in the past year and a half.

He later replied to the newspaper: “No euro was sent to the office in which Dr.

Böcker Partner is, paid. "

The municipal councilor of Jungsfeld described Leininger's statements as "alternative facts", whereupon the latter approached von Jungsfeld with the document during the meeting.

At the request of Armin Mell (FDP), the topic was then ended: the majority of the municipal councils voted in favor - surprisingly, this also included Leininger.

"It's not about mandating," said Egold in conclusion.

Leininger should read the document carefully.

The document is available to the local newspaper and is a copy of a power of attorney for criminal proceedings, signed by Mayor Egold in April 2021. This means that lawyer Böcker is granted a power of attorney to "represent and defend" the investigation against Michael Bernwieser for breach of trust to the detriment of the Seeshaupt community According to Böcker, however, it was not a mandate. “There was never an agency or advisory mandate,” said the lawyer. He only gave the community access to files - and that free of charge.

This was noted on a file from the law firm, which the newspaper also has.

There is also a second power of attorney, which Egold had already signed in February 2021, which also includes access to files - this time for the investigation into possible data changes by Michael Bernwieser.

Böcker initiated the process himself with his complaint last year.

Böcker: "It was a win-win situation for both sides"

This notification was also the reason why Böcker offered the community to inspect the files. "Because otherwise it would probably have been more difficult and delayed for me to gain access," said the lawyer. As one of the complainants against Bernwieser, Böcker would have had to deal with the public prosecutor's office first, as he was not the victim. But the church does. “It was a win-win situation for both sides,” said Böcker. In the municipal council meetings there was also a legitimate interest in the current status of the procedure.

It is questionable whether Seeshaupt will be quiet now, as many citizens would like.

According to Post, Egold received his own information from the local authority.

It is about hiring a lawyer without first asking the local council.

Egold said yesterday morning: "What is practiced here borders on bullying."
