A culprit at all costs, regardless of the truth, is of no use to anyone.

To the judicial system, to the family of little Denise, to public opinion, "which has always followed the dramatic news story with great interest and empathy".

The investigating judge of Marsala is clear and in a 30-page provision explains why, accepting the request of the Public Prosecutor, he decided to close the investigation into the disappearance of little Denise Pipitone, who disappeared into thin air in Mazara del Vallo on 1 September 2004 .

After the now definitive acquittal of Denise's half-sister, Jessica Pulizzi, the mother of the girl Anna Corona, ex-wife of the natural father of the child, Giuseppe Della Key, had been registered in the register of suspects, in a new investigation launched in May. accused of complicity in mafia association, and a couple of Romans, Paolo Erba and Antonella Allegrini who had invented from scratch to be aware of details about Denise's disappearance.

From the "long and incredibly vast investigations" of the prosecutor's office, insufficient elements have emerged to support an accusation in court, says the investigating judge who goes further by writing "that it is not possible to even imagine how a chief prosecutor could be formulated, even summarily of imputation against the Crown ".

"Every accusatory hypothesis against him - he explains - appears at the moment absolutely insensitive to be examined in court and, even less, to lead to an assertion of responsibility. The case returned to the attention of the media after the news given by a Russian TV of the finding of the child, later denied by the DNA examination. Since then there have been false reports to the lawyer of Denise's mother, unreliable witnesses and the statements of a former prosecutor, who investigated Denise in 2004, who allegedly collected news on the affair and which is now being investigated for false information to the prosecutor. In the filing, the judge speaks of "conditioning and evidential pollution that can derive and is derived from the media coverage of the news case and its judicial implications".

The reference is to the two false witnesses who invented that they were in direct knowledge of details about the disappearance of the child who framed the ex-wife of her natural father and who instead, the prosecutors demonstrated, had learned them from television.

"With these considerations - continues the judge - we certainly do not intend to encourage the silence or reticence of those who - even with the privilege of doubt - can provide information of any kind potentially useful for investigations; on the contrary: it is firmly believed that it is the task of the judiciary scrupulously scrutinize any path that can be followed in the search for truth, even and above all after such a long time from the facts, when each investigative 'foothold' appears worthy of further study ".

The filing, however, is keen to underline the investigating judge "does not mean abandoning any hope or concrete possibility of shedding light on the progress of events. On the contrary, as underlined by the prosecutor, it is in the interest of the Prosecutor, it is in the interest of the judiciary as a whole to pursue the truth and continue to investigate where it is hoped that further elements emerge that can be investigated in order to understand what happened Denise and to prosecute those responsible for her kidnapping ".
