Bavarian cinema operator defends itself against 2G-plus and capacity limitation - but it fails

A Nuremberg cinema operator wanted to defend itself against the 2G-plus rule by means of an urgent application.

So he has now failed before the Administrative Court.

Munich - With the help of an urgent application, a cinema operator from the Franconian metropolis of Nuremberg * wanted to take action against the 2G-plus rule in movie theaters.

As part of this rule, cinema-goers, regardless of whether they have been vaccinated or recovered, must also present a negative corona test *.

Now the Nuremberg organizer has failed before the Bavarian Administrative Court.

This was announced yesterday, Tuesday (December 21).

In addition, he went against the rule that cinemas may only be used to 25 percent.

The Court of Justice rejected the application because "the economic impact (...) would have to subordinate the protection of the life and health of a large number of people".

The court regards the measures as generally suitable to combat the Corona * infections.

But there are “certain doubts” as to whether the 2G plus rule is compatible with the principle of equality.

Because the justification for the regulation does not reveal why gastronomy is to be assessed differently from cinemas.

There are no legal remedies against the decision.
