In the parking garage, a woman had slipped on a sheet of ice and injured herself.

Because she slipped on a sheet of ice in the Tölzer parking garage and was injured, a woman sued the city.

The district court has now pronounced a judgment.

Bad Tölz

- A woman from the Garmisch-Partenkirchen district suffered a complicated wrist fracture three years ago when she got out of her car in the Tölz parking garage and slipped on a plate of ice.

The woman subsequently sued the city for compensation for pain and suffering.

The Munich District Court II recently considered the amount of the sum demanded (25,000 euros) to be too high, but it recognized the municipality to be somewhat responsible for the accident.

They agreed on a settlement and a sum of 7,000 euros.

The city's lawyer agreed, but without recognizing any legal obligation.

In plain language, this means that the fall victim cannot claim any further consequential damage, as town hall spokeswoman Birte Otterbach confirmed when asked.

Incidentally, the 7,000 euros will not be paid out of the city wallet.

The city is insured.

Accidents in the Tölzer multi-storey car park: Has this happened before?

Except for the accident and a telephone reference to an ice sheet, Birte Otterbach knows “no further complaints” about ice or even falls in the parking garage.

Puddling caused by drops or vehicles

The court had complained that the drainage in the parking garage, which went into operation in 1999, was apparently inadequate and should have been checked. According to the town hall, the building was built according to the state of the art at the time and was extensively renovated from 2019. However, this was not a consequence of the accident in 2018, but became necessary because water penetrated the concrete and attacked the reinforcement. The concrete has been refurbished and the surfaces have been newly coated. Additional drains were also installed - subject to drainage.

So were there no consequences from the accident?

Yes, answers Birte Otterbach.

The multi-storey car park is built using the cut-and-cover method.

That is why puddles could always form, for example from driving rain or the dripping of rainwater or snow from the approaching vehicles.

For this reason, after the accident, the car park is now "included in the city's winter service plan", according to Otterbach.

This means that "the so-called Handstraßler clear the entrances to the parking garage and also check the parking levels for black ice and, if necessary, sprinkle salt".

These inspections would also be logged by the municipal depot.
