Bill: Limit the length of interrogation and indictment times Israel today

MK Eli Cohen of the Likud submitted a bill seeking to limit the duration of the investigation of the suspect and the length of time until an indictment is filed in his case. This follows the torture of Shas chairman MK Aryeh Deri for six and a half years until signing Yesterday (Thursday) on the plea agreement.

According to the bill, the duration of the police investigation into a "sin" type offense shall not exceed six months;

In an "offense" type offense - up to nine months;

For an offense punishable by imprisonment for more than three years and not more than ten years - up to 18 months;

And for an offense punishable by imprisonment for ten years or more - up to 24 months.

Under the bill, officers of varying degrees will be given the option to extend the length of the interrogation, depending on the level of seriousness of the crime.

The issue of filing an indictment is also set by a deadline: in cases handled by a police prosecutor - up to nine months from the end of the investigation, and in cases handled by a prosecutor from the State Attorney's Office or the District Attorney's Office - up to 12 months from the end of the investigation.

The explanatory memorandum to the law states that "Waiting for a person to complete the said proceedings may harm his dignity and good name, his routine of life, social status and source of livelihood. Therefore, it is proposed to promote a proper balance between his rights as a suspect ".

The bill sets different lengths of time allowed for the interrogation of different suspects depending on the severity of the offense they committed, recognizing the different complexity of the investigation in offenses of different types as well as the time limits for filing an indictment.

In exceptional cases, where a longer-than-usual interrogation will be required, an officer of the rank of non-commissioned officer may extend the interrogation period once more for a period not exceeding six months in offenses of a felony-type offense.

For example from Spain, where in the case of a "simple investigation" the investigation procedures will be carried out by the police during a maximum period of six months and when a "complex investigation" is declared it must be completed within a period of 18 months.

In France, if two years have elapsed from the date of the opening of the investigation, the investigating judge will write a reasoned decision in which he will address the above parameters, explain the reasons for the length of the investigation and the justifications for its continuation.

MK Eli Cohen said: "Limiting the length of the police investigation and the prosecutor's office's decision is primarily intended to prevent unnecessary torture of detainees and is also intended to prevent lip service, which prolongs the process of making elected officials held captive by the prosecution and the attorney general."
