In the standoff between it and Poland over the rule of law, the European Commission has just taken a significant step forward.
On Tuesday, she launched infringement proceedings against Warsaw, arguing that its Constitutional Court openly challenged the rule of European law.
"We consider that this case law has violated the general principles of autonomy, primacy, efficiency and uniform application of Union law and the binding judgments of the Court of Justice of the EU",
states the European executive.
In October, Polish constitutional judges ruled several articles of the Treaty on the Functioning of the Union incompatible with the Polish Constitution and refused to apply rulings of the Court of Justice of the European Union (CJEU).
Aggravating circumstance, the request came from Prime Minister Mateusz Morawiecki.
