Surprisingly, the full board met on Wednesday. Barthel hired a lawyer after the vote was lost, Holz reported. "Not only did she inform us of her legal opinion, she also threatened the community with a lawsuit on behalf of three members of the municipal council."

Holz didn't bother to hide his anger: “I've never seen anything like this in 14 years as mayor,” he grumbled.

“In the Bundestag it may be common practice to complain about each other.

But that doesn't fit into the local council at all. "He has a different understanding of democracy:" If you can't convince the majority of the committee and you are defeated, you have to accept that. "

Holz added: “The majority of the local council and I will not allow the reputation of this venerable body to be damaged further for personal reasons.” He would “itch” to allow a legal dispute to come down to it: “But that would be over Months or years tie up a lot of money, time and human resources - and we have far more important things to do in the coming months. "

Holz left no doubt that he considers a crisis committee to be the only right decision.

Dispute over regional plan

These statements were initially uncommented. Wood chased through the following items on the agenda, there were no requests to speak. Until the language came up on the regional plan. In the past eight years, the number of inhabitants in the district has risen by almost six percent and the number of employees subject to social insurance by almost 20 percent. The State Office for Statistics predict a further increase. Under these framework conditions, the municipality is under a “certain pressure to move” to designate new building areas, according to Holz. The regional plan should coordinate this in the most environmentally friendly and nature-friendly way possible.

The building committee dealt twice with the topic and thought about where Kochel could grow in the next 10 to 30 years.

In Ried, the existing zoning plan fits, the place will not get much bigger.

In Walchensee, on the other hand, a small area is not yet included in the zoning plan.

The administration in Kochel has invested a lot of time and effort to find out where there is potential for development.

The result: "In the Altjoch / Kesselberg area we could imagine that something would develop." The area around the campsite is already built on and has good traffic connections.

This is where Barthel hooked up.

Looking at Holz, he said: "What you are describing runs counter to the objectives of the regional plan in my opinion."

After he had started to explain, Markus Greiner raised his arm and requested that the subject be put to the vote immediately. “I have the floor,” replied Barthel. Holz countered: “May I interrupt you, because I am in charge of the meeting. I have to put a vote when a point of order is put up. ”This is only allowed when he has finished speaking, said Barthel. Now Holz added: “Mr. Barthel, we met twice on the building committee and you didn't say a word. And now you come back with such a 20-minute speech. "

Barthel replied that there was no talk of Altjoch in the building committee.

In addition, wood should not say what was discussed in non-public meetings.

Now wood burst: “Now it’s going to start again that you accuse me of violating the rules - I’m getting very angry.

I only noticed that you were present at two building committee meetings. ”That closed the dispute.

With two votes against, the committee decided that the vote should take place immediately and that the areas should be reported to the regional plan officer as planned.

Mr Barthel, why are you against a crisis committee?

There is no longer any justification, you can meet in compliance with the regulations.

The Constitutional Court has confirmed this.

The verdict is there, the problem also existed in other cities and municipalities.

Our lawyer has set that out.

I suspect Mr. Holz has seen that he will not get through.

Do you suspect that the decision to join the crisis committee was for political reasons?

One can guess.

Last year there was already a crisis committee - the Constitutional Court's judgment had not yet been issued.

At that time, everything was decided in the committee, including the budget.

Basically in camera, nothing was discussed.

Then you noticed that it wasn't going to work that way, the Bavarian Ministry of the Interior represented an incorrect legal opinion.

This was cured by the fact that the new local council decided on the same budget - without consultation.

The thing with the amplifier office was largely pushed through during this time.

The report to the regional planners also seems to displease you?

It cannot be said that traffic avoidance takes place in Kochel.

In Altjoch and Ried, for example, no social housing is being built.

They are again using land with single-family houses for rich people.

This is precisely what contradicts the objectives of the regional plan.

Is it true that you didn't say a word on this subject in the building committee?

Of course that's not true.

I have said several times that we need to look closely at the regional plan.

I was unable to attend one of the two meetings mentioned because Mr Holz is constantly rescheduling appointments.

I couldn't change my plans anymore.

There was also no need to decide that immediately on Wednesday.

We would have had until spring to deal with the subject in peace.

As hardened as the fronts are: Do you still have a chance to get something through?

I find the situation very unfortunate.

In the Council there were some concerns about the crisis committee.

A year ago three people voted against, this time there were seven.

That makes me optimistic.

Do you see a way out of the conflict?

You could sit down and talk about a few things.

It was completely unnecessary for Mr. Holz to get involved in this dispute.

He didn't take what we were saying seriously.

So we tried to clear it up outside the public eye with the legal letter.

He could have just said: "Sponge over it, done." I'm at a loss as to how to get out of there.

I haven't seen anything like that in a communal body.
