Among other things, the Senate complained that there were no reliable and comprehensible findings on the actual risk of infection in retail. In addition, the state could oblige retail customers to wear an FFP2 mask. This would reduce the risk of infection to such an extent "that it could almost be neglected," said the court.

Federal Justice Minister Marco Buschmann defended the judges on Twitter.

Government spokesman Steffen Hebestreit said that the access rule was only considered to be useful for vaccinated and convalescent people (2G).

The Federal Government is also convinced that the Infection Protection Act is clear on this matter and forms a good framework.
