A forty-something was tried this Tuesday afternoon for having threatened with death by messages and video his ex-wife. But, at the hearing, the el

The file is "a fiasco", admits the lawyer of the civil party: "There is not much that holds.

“His client, mother of four children, filed a complaint on December 21 at the Bobigny police station, following the threat of too many.

Her ex-boyfriend, in his forties, was filming a live video on Facebook.

He stood in front of his parents' home, handgun in hand, threatening them with death if the young woman did not come with him.

The video has been deleted.

But at the police station, the victim shows messages to the police, written and oral, where insults and death threats are heard.

The president read some of them to the audience: "The day I catch you, I will put your eyes out";

"In a month, I will find you all and burn you all";

"You're just a bitch, that's why I burned your face with a cigarette";

and the last, dated December 23: "Until I put a rope around your neck to hang you, I will not let you go."

A total of fifteen are reported and recorded by police officers.

The man denies all of the messages.

For the video, he downplays and only admits that he was annoyed by not being able to see his children for years.

Prevention does not apply to the film, which has been deleted.

At the bar, the young woman indicates that only one of the messages comes from her ex-spouse, the one about the cigarette burn.

The others come from the parents of the accused.

"So we just have a message, not reiterated and no date", loose the president.

The court recalls that it is seized for "sir and not the whole family".

"Indeed, there is nothing in this file"

"When was this message?"

», Asks the magistrate.

The civil party gives a month which is not targeted by prevention either.

"It is not the fault of my client if the police did not time-stamp the messages, underlines his advice.

If she deprives this father of the visit of his children, it is because there is danger in the home.

We were successful in obtaining a protection order on September 17, 2020, but it is no longer valid.

"

The lawyer concedes "that indeed, there is nothing in this file", and regrets that "the diligence carried out is not up to the suffering of my client which has lasted for several years.

Perhaps one day, we will open a judicial investigation but I hope that it will not be in dramatic circumstances.

"

The prosecution also requires the release, "not for a question of timestamp or deleted video but because today, only one of the messages comes from the accused".

The defendant's lawyer points out that an investigation has already been carried out and that his client has already obtained an acquittal.

He believes that this case should be settled before the family court judge, and asks for an acquittal.

A request followed by the court at the end of its deliberation.
