Judges confirm dance ban in Berlin clubs

The ban on dancing in Berlin clubs and discos will initially remain in place.
This was announced by the Berlin Administrative Court on Tuesday after it had rejected urgent applications from club owners and organizers.
According to the judges, the ban represents a “significant encroachment on the freedom of occupation”.
However, there are currently no milder means available.

The judges did not fail to recognize that other measures such as a negative test, a full vaccination or proof of recovery in combination with a hygiene concept reduced the risk of new infections.
In fact, the only way to prevent infection is through a ban.
At dance events, there is a particularly high risk of infection through aerosol transmission, argued the judges.
Over a longer period of time, a larger number of people are in closed rooms and dancing leads to increased breathing activity.
People speak loudly in the face of loud music - and in the case of “alcohol-related disinhibition”, the rules of distance would typically be quickly forgotten.

According to a court spokesman, a total of a dozen club owners and organizers had opposed the ban.
Appeals against the resolutions can be lodged with the Higher Administrative Court in Berlin-Brandenburg.
