Today, President Bashar al-Assad issued Law No. 38 of 2021 regarding vocational education, which aims to organize its course and secure working cadres that meet the needs of the labor market from various professions and provide training for students in the real work environment by establishing training centers and production workshops for the vocational high school in order to raise Together with its graduates from a scientific and practical point of view, in order to contribute to supporting the production process and achieving sustainable development.

And what was approved by the People’s Assembly in its session held on 4/27/1443 AH corresponding to 12/2/2121;

It issues the following:

chapter one

Tariffs

Article 1 –

In the application of the provisions of this law, the following expressions and words shall have the meaning indicated next to each of them:

Ministry:

Ministry of Education.

Minister:

Minister of Education.

- Vocational education:

An educational system at the secondary level, with a duration of three years, aimed at providing students with theoretical knowledge and practical skills to meet the needs of the labor market.

Dual education:

Vocational education, carried out through a partnership between the education sector and the business sector.

- Education sector:

The Ministry and other bodies of ministries, departments and educational institutions that carry out vocational education.

- Business sector:

Institutions, companies, economic events, chambers of agriculture, industry, commerce and tourism, and the Federation of Chambers of Maritime Navigation, whether in the public, private or joint sectors.

Central Vocational Education Committee:

Vocational Education Committee formed in the Ministry.

Vocational Education Subcommittee:

The Vocational Education Committee formed in the education directorates.

Vocational high school:

The educational facility in which the student receives theoretical and practical knowledge and sciences from the education sector.

Economic establishment:

Factories and workshops for the business sector in which the student receives practical training.

Production centers:

Updated workshops in or outside vocational high schools, or training centers, in order to conduct manufacturing, maintenance, repair, service and training operations.

Administrative Committee:

The administrative committee formed in the vocational high school.

Chapter II

Creating a professional education

Article 2 -

In the Syrian Arab Republic, within the secondary education stage, a vocational educational system aims to prepare professionals to meet the needs of the labor market and sustainable development, called vocational education, according to the following provisions:

  • A- A student who holds a Syrian Basic Education Certificate or its equivalent is accepted in vocational education according to instructions set by the competent minister before the start of each academic year.

  • b- The duration of the study is three years, starting from the first secondary vocational grade until the end of the third vocational secondary grade.

  • C- Studying in vocational secondary education ends with a general examination, in which the successful ones are awarded the vocational secondary certificate, in which the profession is determined according to a unified model prepared by the ministry, signed by the competent minister or his representative, and its origin is kept in the competent ministry.

  • d- The vocational secondary certificate entitles its holder to pursue his university or technical studies in accordance with the admission terms and criteria approved by the Ministry of Higher Education and Scientific Research.

  • e- The vocational secondary certificate entitles its holder to obtain a license to practice the profession after completing the procedures for granting the license with the concerned authorities.

Article 3 –

A- 1- Specialized professional curricula are prepared in coordination between the Ministry and the competent ministries, and are issued by a decision of the competent minister.

  • Curricula of basic sciences and general culture are prepared by the Ministry, and issued by a decision of the Minister.

  • The Ministry shall set a unified system for examinations in coordination with the relevant ministries, and it shall be issued by a decision of the Minister.

Article 4 –

Vocational education secondary schools are established in the governorates by a decision of the competent minister based on the proposal of the sub-committees and the approval of the Central Vocational Education Committee in accordance with the provisions of this law.

Article 5 –

Professions are determined or replaced in secondary vocational education by a decision of the competent minister, based on the proposal of the sub-committee and the approval of the Central Vocational Education Committee.

Article 6 -

  • a- It is permissible to establish secondary schools for dual vocational education in coordination between the education sector and the concerned business sector in accordance with the provisions of this law.

  • B- Coordination includes the participation of the concerned business sector in proposing curricula items for technical subjects and practical exercises, and their participation in their training and practical tests.

Article 7 –

Production workshops and training centers affiliated with vocational education may be established by a decision of the competent minister, and the mechanism and rules of work therein shall be determined by a decision from him.

Article 8 -

The education sector may contract with the business sector contracts related to work in production workshops and training centers. The mechanism and rules for concluding these contracts shall be determined according to a special system issued by a decision of the competent minister.

Chapter III

Objectives

Article 9-

This law aims to organize the vocational education path and secure working cadres that meet the needs of the labor market in the public, private and joint sectors of various professions, in addition to training in the real work environment by creating training centers and production workshops for the vocational high school, in order to raise the level of vocational education graduates in terms of Scientific and practical, in order to contribute to supporting the production process, and achieving sustainable development.

Article 10 –

To achieve the objectives of this law, the Ministry shall undertake the following tasks:

  • A- Linking vocational education plans with economic development plans to meet the requirements of the renewable needs for the development of the national economy.

  • b- Orienting secondary vocational education curricula to meet the needs of social and economic development.

  • C- Qualifying students according to their abilities and tendencies, and according to the needs of the business sector, and preparing a generation of graduates equipped with theoretical knowledge, experience and practical professional skills.

  • d- Enhancing integration between theoretical study and applied practical study, and providing students with skills of scientific thinking and self-learning to enable them to develop their abilities and continue innovation and innovation.

  • e- Preparing vocational education students to integrate into the labor market and contribute to it through a correct understanding of the individual's role in society.

  • f- Enhancing the principle of quality at work and the values ​​of teamwork.

  • g- Appreciating and respecting professions of all kinds, and training students to rationalize and use resources in order to achieve production at the lowest cost.

  • h- The participation of the business sector in the development of human resources through a dual process of education and training.

Vocational Education Committees

Article 11-

  • A- By a decision of the Minister, the Central Vocational Education Committee shall be formed as follows:

  •      Minister

president

  •     Assistant Minister for Vocational and Technical Education

Member and Vice President

  •     Assistant Minister of Social Affairs and Labor

member

  •      The assistant minister concerned with each of the ministries concerned with vocational education

members

  •    A representative of the Revolutionary Youth Union

member

  •    Director of Vocational and Technical Education in the Ministry

member

  •    Director of Legal Affairs at the Ministry

member

  •    Examination Director in the Ministry

member

  •    Administration accountant in the ministry

member

  •        A representative of (Federation of Chambers of Industry, Federation of Chambers of Maritime Navigation, Federation of Chambers of Commerce, Federation of Craftsmen, Federation of Chambers of Tourism and Federation of Chambers of Agriculture)

members

  •        Two experts appointed by the Minister

  • b- The committee shall be concerned with the following:

  • 1- Proposing the educational policy for the vocational education system and submitting it to the Council of Ministers for approval.

  • 2- Setting the necessary steps for implementing this policy, supervising its implementation and expanding the vocational education system.

  • 3- Suggesting legislation for the development of vocational education.

  • 4- Laying the foundations related to the development of vocational education to advance it, raise the level of its graduates, and link it to the labor market.

  • 5- Taking the necessary measures to create new professions in line with development plans and taking into account scientific developments.

  • 6- Develop a general system for vocational guidance and counseling and follow up its implementation with the concerned authorities.

  • 7- Supervising the work of the vocational education sub-committees and following up on the implementation of their tasks.

  • 8- Approving the creation of vocational education secondary schools and types of professions or changing them based on the proposals of the sub-committee.

  • c- The committee meets at the invitation of its chairman every six months and whenever necessary.

  • d- The committee may seek the assistance of whoever it deems appropriate from the experts and specialists without having the right to vote.

  • e- The committee takes its decisions by the majority of the votes of its members present.

Article 12-

  • A- The Vocational Education Subcommittee shall be formed in each governorate by a decision of the Minister as follows:

  •        Director of Education

president

  •        Assistant Director of Education for Vocational and Technical Education

Vice President

  •        A representative of the Directorate of Social Affairs and Labor

member

  •        A representative of the Revolutionary Youth Union branch

member

  •        Head of the Vocational and Technical Education Department in the Directorate

member

  •       Head of the Legal Affairs Department in the Directorate

member

  •        Accountant for the Department of Vocational and Technical Education in the Directorate

member

  •       A representative of each of the directorates concerned with vocational education in the governorate

members

  •        Specialist mentor for vocational education in the directorate by profession

member

  •       A representative of the Chamber of Industry, Commerce and Agriculture, the Federation of Craftsmen in the province, and the Federation of Chambers of Maritime Navigation

members

  • B- The committee meets at the invitation of its chairperson, and the committee undertakes the following tasks:

  • 1- Implementing everything related to the educational policy for vocational education, or proposing to amend it.

  • 2- Suggesting the professions needed by the governorate’s regions or exchanging them according to the requirements of the labor market.

  • 3- Proposing the creation of vocational education secondary schools in the governorate’s regions.

  • 4- Cooperating with the business sector to train vocational high school students in institutions, companies, laboratories, and other bodies.

  • 5- Studying and processing reports received from the administrative committees in vocational high schools.

Article 13-

  • A- By a decision of the competent minister or his representative, in each vocational high school, an administrative committee composed of:

  •        Vocational high school director

president

  •       Assistant Director of Vocational High School

member

  •       Head of technical lessons

member

  •       Head of the relevant department

member

  •       A qualified teacher, craft teacher, or assistant teacher from among those in charge of the work.

member

  •        A representative of the concerned business sector in case the vocational high school is within the dual education system.

member

  •       Professional secondary accountant (or certified payroll in the absence of an accountant)

member

  •       warehouse keeper in high school

member

  •       A representative of the youth unit

member

  • B- The Administrative Committee shall undertake the following tasks:

  • 1- Follow up the education and training of students.

  • 2- Follow-up on developments in the labor market and the impact of their reflection on education and training in vocational high school and in the economic establishment.

  • 3- Securing education and training requirements, studying obstacles and working to address them.

  • 4- Supervising the entry and exit of production and maintenance requirements from and to the vocational high school.

  • 5- Studying and evaluating the scientific, educational and professional conditions of students.

  • 6- Suggesting incentive bonuses for teachers and students.

  • 7- Marketing the productive work of the vocational high school.

  • 8- Proposing the production and financial plan for the vocational high school in coordination with the heads of departments.

  • 9- Proposing the formation of allegiance, purchase and consumption committees.

  • 10- Follow up on the implementation of ministerial instructions.

  • 11- Determining indicative prices for manufactured products in light of the specifications of materials and services included in the production processes, taking into account the provisions of the laws in force.

Chapter V

production centers

Article 14-

Subject to the provisions of the Local Administration Law, the competent minister may take vocational high schools with all their professions and the training centers and workshops affiliated to them as production centers in accordance with instructions issued by him, and allow their departments to engage in the following activities in whole or in part:

  • A- Manufacture of machines, tools, equipment and other products within its competence and sell them in accordance with the provisions of the laws in force without affecting the implementation of the prescribed curricula.

  • b- Contracting through the relevant directorate to which the secondary school belongs with the business sector on training, manufacturing products and carrying out various repairs and services within its jurisdiction.

  • C- Selling the products of training exercises implemented during the academic year at a price determined according to the principles and rules mentioned in the executive instructions.

Article 15-

The Minister, in coordination with the Minister of Finance, shall issue a decision specifying the basis for distributing revenues resulting from production, maintenance and service contracts, taking into account the payment of the cost value to the public treasury, and the net profits shall be distributed according to the following:

  • ‌أ- 50% خمسون بالمئة تعويضات وحوافز ومكافآت للعاملين، والمشرفين على أعمال الإنتاج والخدمات، وللطلاب المشاركين في الإنتاج.
  • ‌ب- 50% خمسون بالمئة لتطوير العملية الإنتاجية وفق الآتي:
  • 1- المساهمة في شراء الآلات والأدوات والعدد ومستلزمات التدريب والإنتاج للثانوية المهنية.
  • 2- المساهمة في دفع أجور صيانة الآلات والأدوات والعدد في الثانوية المهنية.
  • 3- المساهمة في تأمين المستلزمات والنفقات اللازمة لتنفيذ الأعمال المشاركة في المعارض المحلّية والمركزية.
  • ‌ج- يدوّر الفائض من الأرباح في السنة المالية للسنة المالية التالية.

المادة 16-

يتمّ فتح حساب مصرفي لكلّ ثانوية مهنية تقوم بأعمال الإنتاج والخدمات، يحرّك من قبل الوزير المختص أو من يفوضه ويودع فيه الآتي:

  • ‌أ- الإيراد الناجم عن مراكز الإنتاج.
  • ‌ب- الهبات والتبرعات النقدية وفق القوانين والأنظمة النافذة.
  • ‌ج- أي مبالغ أخرى تسمح بها القوانين والأنظمة النافذة.

المادة 17-

يجوز بقرارٍ من الوزير المختص افتتاح صالات لعرض وبيع المنتجات في الثانويات المهنية والمشاركة في المعارض والأسواق.

المادة 18-

يجوز بقرارٍ من وزير المالية بناءً على اقتراح الوزير المختص منح الثانويات المهنية أو الورشات المشاركة بالإنتاج سلفة من أموال الخزينة العامة حدها الأقصى /10,000,000/ ل.س عشرة ملايين ليرة سورية على أن تسدد في مدة أقصاها 31-12 من العام المالي الذي تمّ فيه منح السلفة.

الفصل السادس

أحكام عامة وختامية

المادة 19-

  • ‌أ- يتقاضى العاملون المكلفون في الثانويات المهنية بالأعمال الآتية (مدير- معاون مدير – رئيس دروس فنية – رئيس قسم – أمين مستودع – مدرس مهندس – مدرس – مدرس مساعد – معلم حرفة) تعويض طبيعة عمل مقداره 40% أربعون في المئة من الأجر الشهري.
  • ‌ب- يتقاضى العاملون المكلفون في الثانويات المهنية بباقي الأعمال الإدارية غير المذكورة في الفقرة (أ) من هذه المادة تعويض طبيعة عمل مقداره 10% عشرة في المئة من الأجر الشهري.
  • C- The compensation stipulated in this article is calculated on the basis of the monthly wage on which the compensation in force in Legislative Decree No. 27 of 2020 is calculated.

  • D- The provisions of Legislative Decree No. 27 of 2020 do not apply to vocational secondary schools affiliated with the Ministry of Education.

Article 20-

The incentives and rewards mentioned in this law are not subject to the limits of incentives and rewards mentioned in the laws and regulations in force.

Article 21-

Legislative Decree No. 13 of 1994 is repealed, and the provisions of Legislative Decree No. 39 of 2001 do not apply to vocational secondary schools in all ministries.

Article 22-

The executive instructions necessary to implement the provisions of this law shall be issued by a decision of the Minister and in coordination with the concerned ministries.

Article 23-

This law to be published in the official newspaper.
