Court: 2G rule continues to apply in textile retail

Visiting boutiques and other clothing stores in Thuringia is still only reserved for vaccinated and convalescent people.
The Higher Administrative Court (OVG) confirmed the applicable 2G rule for the textile retail trade, as a spokeswoman announced on Thursday in Weimar.
The passage in the Thuringian Corona Ordinance of December 23 is therefore valid for the time being.
Weimar - According to the OVG, the decision is final.
A nationwide company that also has branches in Thuringia has sued the 2G regulation.
Its urgent application was rejected by the judges.
The background to this is that in some other federal states, including Lower Saxony, the 2G rule in the textile retail trade has been lifted.
The FDP and AfD in Thuringia had pleaded for repeal in Thuringia as well.

The decision in Lower Saxony does not match the Thuringian legal situation, explained the Thuringian OVG.
The reason is the significantly stronger infection rate in Thuringia as well as "the plausible approach of the Thuringian regulators to fundamentally prevent infection-transmitting contacts in particular of more vulnerable groups of people in this dramatic situation", the judges justified the rejection of the urgent application.
This applies all the more to the Omikron virus variant.
According to the court, the question of equal treatment, which the company raised in its lawsuit, is to be clarified in the main proceedings.
