Due to the corona pandemic, many facilities for sport could not be used to their full extent

Zorneding - Who pays, creates? In the case of TSV Zorneding, this only applies to a limited extent. In the last meeting of the municipal council, the rent paid from the club's treasury to the Zornedingen town hall administration was discussed. Because the management of the TSV had asked in a letter for the repayment of the lease fees paid for the sports grounds. Due to Corona, the stadium and all other physical fitness facilities were closed. Thus, the club's management was sure that you didn't have to pay anything for something that wasn't usable.

There was actually agreement and consent among the local councils. Mayor Piet Mayr did not want to be messed about either. But very few knew that this was not always the case: As early as 2020, the then chairman Bohdan Kalwarowskyj approached the town hall chief to claim back the lease money paid despite the corona-related site closure. And Mayr was anything but amused, as Kalwarowskyj announced when we asked. Only further discussions brought the mayor to give in. From a purely legal point of view, he had no other choice; The legally well-equipped TSV president at the time knew that. That is why he had not asked for the money, but demanded it very clearly after the resistance brought against it, referring to the German Civil Code (BGB).In the council meeting there was no contradiction because of this demand, but it was suggested that the membership fees should also be reimbursed. This point was only discussed further insofar as the municipal council recommends that the management of the association pay back the members' contributions from corona blocking times. But as an outsider you couldn't do more than that, said Piet Mayr.

But one knows about dissatisfied club members, he added.

Apparently, the town hall does not know that the association's statutes do not currently provide for a refund of the contributions and that the non-profit law does not allow a repayment so simply.

Only a general assembly could adjust the membership fees by resolution.

If the majority were in favor, the contributors could be relieved accordingly.

The board of the TSV did not include this point in the general meeting.

The TSV, on the other hand, can be certain that part of the lease will be repaid: 26,534 euros will be returned.
