Two passengers were compensated by American Airlines for about $ 1,700 each, after being promised to receive kosher food during a flight, and eventually not receiving the food and forced to fast.
A judge in Brazil ruled that the company did not provide the services it promised to provide, and therefore must compensate both passengers.
One passenger traveled without food for 10 hours during a flight from New York to Sao Paulo, and the other fasted for nine hours during two flights - from Madrid to Philadelphia and Chicago to London.
The JTA website stated that airlines are not required by law to provide any food, but in both the US and Brazil consumer protection laws can lead to a lawsuit against service providers once they have undertaken to provide a particular product. American Airlines offers passengers kosher food, Brazil can only get kosher food if they leave Sao Paulo or Rio de Janeiro.
Judge Jose Marcus Marona wrote in his ruling that the airline undertook to provide kosher food to one of the passengers but in practice during the flight he was not served food, and he was forced to remain fasting for ten hours of flight.
Therefore, from the judge's point of view there is "moral damage" caused to the plaintiff and they are the ones responsible for the forced fasting during the flight.
Also in the second case, the judge found that the airline did not provide services and caused emotional suffering to the passengers.
