A 47-year-old kiosk operator has been sentenced to eight years in prison for attempted murder.

At the same time, the district court suspended the defendant's arrest warrant: because he had already served a significant part of the sentence while in custody, there is no longer any risk of escape.

If the Federal Court of Justice (BGH) confirms today's sentence, the man will have to be detained again to serve the remaining sentence.

Düsseldorf - The Federal Court of Justice had overturned the man's sentence of seven and a half years in prison for particularly serious arson and ordered the trial to be reopened.

According to the BGH, the 47-year-old should have been convicted of tenfold attempted murder.

According to the indictment, the 47-year-old Turk set fire to his unused, unprofitable kiosk in a five-story apartment building in Düsseldorf on the night of March 5, 2018 in order to save rental costs.

Defense attorney Wolf Bonn had requested an acquittal and announced another appeal against the judgment.

At the time of the crime, his client was lying in bed with his febrile child.

The prosecutor had requested nine years in prison.

According to the indictment, the man had poured gasoline and started fires in four different places in his unused kiosk on Düsseldorf's Münsterstrasse.

At the time of the crime, ten residents were sleeping in the apartment building.

No one was injured in the fire.

The fire brigade was able to prevent the flames from spreading to the apartments above.

The kiosk operator has always denied the allegations.
