Court rejects urgent application from shoe store against 2G rule

A shoe shop failed with an urgent application against the 2G rule before the Administrative Court (VGH) Baden-Württemberg.
The demand to allow access not only to those who have recovered and who have been vaccinated as customers has been rejected because the number of infections is currently rising sharply, the Mannheim judges announced on Wednesday.
They referred to the recommendations of the Robert Koch Institute to apply the 2G regulation for access to shops and the 3G regulation for access to everyday shops.
Mannheim - 3G means access for those who have recovered, vaccinated and those who tested negative.
The court did not follow the argumentation of the branch of a company based outside Baden-Württemberg, there were only minor infections in the retail sector.
The causes of the infection are currently rather diffuse.
The Luca app, the data of which the applicant relies on, is often not used at all in retail.

The plaintiff also alleged that shoe stores served the basic needs of the population.
The 1st Senate countered this: "Usually every citizen should have enough shoes to cover any need for new purchases that may arise at short notice."
The decision of the VGH is final (Ref .: 1 S 3781/21).
