The decision on such an application lies with the Federal Constitutional Court.
According to previous jurisprudence, the prerequisite for this is, among other things, an actively combative, aggressive attitude towards the free democratic basic order, which the party in question is aiming to abolish.
It is also relevant how important the party is, i.e. whether it can actually implement its program and become so dangerous to the state.
Last year, Wanderwitz caused controversy in his own party with statements that some of the AfD voters were permanently lost to democracy.
In the federal election he lost his direct mandate in the constituency of Chemnitzer Umland - Erzgebirkskreis II to an AfD politician, but moved back into parliament via the state list.
