Many people are unaware that it is possible to claim compulsory bus insurance.

This refers to situations in which while boarding the bus, the driver accidentally closed the doors and injured you, or you reached the designated station and got off the bus, slipped on the stairs, fell and suffered physical damage.

Even when the bus driver brakes suddenly and hard and you "flew" and were injured - all these cases are considered road accidents, and for that you deserve compensation from the bus company's compulsory insurance.

In fact, a car accident can occur as long as the use of the vehicle has not ended. Even during entry and exit from a vehicle, private or public, this is considered a road accident.



A great many passengers, especially seniors, are injured while traveling. Most injuries occur when a bus driver brakes hard, and adults and the elderly, who suffer from instability due to their age, tend to fall and get hit in the head or limbs. Many times they also slip on the steps of the bus, break their limbs and suffer physical damage and injuries that are very difficult for them to recover from. These accidents are not simple at all and if that happens, there are those to sue.



But not just the elderly. One of our customers, a 26-year-old man, was sitting while riding a bus. The driver stopped abruptly and braked hard, and the young man's head dropped powerfully back and forth, in what is known in medical parlance as a 'whiplash'. The young man said nothing to the driver, but immediately went to a medical emergency center due to neck pain. Because the accident occurred while on his way home from work, it is considered a work accident, and the National Insurance Institute did recognize it as such and paid him the required compensation.

At times, in what appears to be a minor accident, the injury may turn out to be severe. The young man in this case was left with a slight disability due to a restriction in the movement of the neck. In the present case, due to lack of awareness of the issue, the young man did not update the bus driver and we had to locate him and find witnesses to the incident. However, as soon as we located the bus company, we started the lawsuit process against them.



In another case, a woman, an architect by profession, tripped during her getting off the bus and broke her arm. The bus driver closed the door and continued to drive, but fortunately for the woman, a person present at the scene photographed the bus' license number, and the woman contacted the police and reported the incident.



It is important that the response be immediate because it will be evidentially easier to prove that the accident did occur. If the reaction to the incident is delayed, we will have to deal with a legal argument of ‘word against word’, the testimony of the passenger versus that of the driver, then the legal proceedings may get complicated.



3 important actions in case you were injured while riding a bus:



• Report to the driver and ask to photocopy the bus documents and his driver's license.



• If the driver does not cooperate, photocopy the bus license number to contact the bus company and report the accident.



• Write down the exact details: where you got on the bus, where you intended to get off, where the accident happened and which bus line it was.

The more details there are, the more beneficial it will be to sue and you will be able to get compensation for the damage done to you.
