A Porsche and a Mercedes driver met in front of the Munich II regional court.

The men's cars driving one behind the other had touched each other in November 2020 while overtaking on the B11 near Bad Heilbrunn.

Everyone thought the other was the cause of the accident, which thankfully only resulted in sheet metal damage.

Porsche versus Mercedes': Accident on B11 leads to the regional court

The plaintiff in the Porsche drove northwards behind a van at around 3:45 p.m. on that day in November, the driver of which was traveling at 60 to 70 kilometers per hour.

Between the junctions of Letten and Brandl, the Porsche driver started to overtake shortly before a left-hand bend.

There was a side collision between the two vehicles in the bend.

The person overtaking demanded compensation for his vehicle damage.

He claimed that the father of the family in the Mercedes van had carelessly cut the curve.

The defendant denied this and claimed that the Porsche driver drove into his car.

The civil chamber heard both parties, the wife of the van driver was questioned as a witness and an expert heard.

He thought both versions were technically possible.

The van driver could cut the curve, but the Porsche driver could have drifted tangentially out of his lane while overtaking.

The latter would have been possible in particular if the plaintiff had accelerated or slowed down in the curve.

Because both cause a reduction in cornering forces, according to the expert.

The expert stated that this could already happen if the plaintiff took his foot off the accelerator in the curve.

The Porsche driver wanted to categorically rule out drifting out of the curve.

He completes an annual driver safety training, in 2020 he even took part in a circuit training on the Nordschleife of the Nürburgring, according to his own statements.

The man claimed that he was very familiar with his vehicle.

After the B11 accident: the district court suggests a settlement

The expert countered, however, that in view of the speeds indicated by both parties, an overtaking maneuver in the accident curve could not be carried out safely, and not even with the plaintiff's Porsche.

Against this background, the Regional Court of Munich II suggested a settlement.

The van driver's insurance covers 30 percent of the amount claimed by the Porsche driver.

Or to put it another way: The Porsche driver gets almost 3000 euros, he asked about 7000 euros.

However, the damage to the Mercedes was not taken into account in the proceedings.

Both sides still have to agree on this, or the family father may still have to sue for the amount.
