Court: AfD is not allowed to run with a list for Saarbrücken

The AfD Saarland is not allowed to run its candidate list in the Saarbrücken constituency for the state election on March 27th: it must withdraw the district election proposal submitted to the district returning officer, the Saarbrücken regional court announced on Thursday the decision of the 16th civil chamber.
With this, the judges granted the request for an interim injunction by, among others, the former AfD state chairman Josef Dörr.
Saarbrücken - Since the state board of the AfD was not effective in office after a not yet legally binding ruling by the Saarbrücken regional court in mid-December, "all measures that the current board has taken are ineffective on their part," the court said. This also includes the invitation to the election meeting on November 27th - as well as the resolutions and elections made at the meeting.
There is a second reason why the district nomination list is ineffective: In the Chamber's view, the electoral assembly was not properly staffed, as nine members who were not properly accepted had voted in the vote.
This is also relevant for the voting result, since there was only a difference of just two votes between the two candidates for list position 1, the court said.
The state chairman of the AfD Saarland, Christian Wirth, said after the decision that he would appeal.
He had also appealed against the judgment of the regional court in mid-December.
He assumed that there would be no final decision before the state elections.

According to the state election management, in the state election in a constituency, a party can only be elected with a district nomination.
A district election proposal is a prerequisite for the party to appear on the ballot in the constituency, said a spokesman.
Wirth said that without the “Saarbrücken List”, the party would have to fear that it would be rejoined in the state parliament.
There are three constituencies in Saarland.
