Judge declares unconstitutional the imprisonment of a migrant in Texas for crossing the border illegally

The decision of the magistrate is a blow to the order of the governor, Greg Abbott, with which he intends to impose prison sentences on undocumented migrants, accusing them of trespassing on private property when entering the United States irregularly.


A judge in Travis County, Texas, presented a major challenge to

Judge Jan Soifer ordered the case against Jesús Alberto Guzmán Curipoma, an engineer from Ecuador who was arrested in September on trespassing charges, to be dismissed.

Soifer agreed with defense attorney Angelica Cogliano, who argued that Operation Lone Star usurped the powers of the federation by putting immigration enforcement in the hands of state and local authorities.

In addition to jailing migrants, he has vowed to build new stretches of border wall, has closed official ports of entry multiple times due to migrant arrivals, and has deployed the Texas National Guard along the border.
