President Bashar al-Assad today issued Legislative Decree No. /2/ to grant workers in public oncology hospitals a compensation for the nature of work on the basis of the monthly wage lump sum on the date of work performance.


Below is the text of the legislative decree:

Legislative Decree No. / 2/

President of the Republic

According to the provisions of the Constitution.

Article

1 -

Workers in general hospitals specialized in oncology shall receive compensation for the nature of work on the basis of the lump sum monthly wage on the date of work performance, according to the following:

A- Workers in the departments of radiotherapy, nuclear medicine, chemotherapy, blood stem cell transplantation, and medical physics as follows:

Nuclear Medicine Doctors

Bachelor's degree in chemistry, pharmacy or life sciences

55% fifty five percent

Technological Institute of Radiology or University Degree in Radiation Therapy

55% fifty five percent

Class I or Class II Nursing

55% fifty five percent

 The rest of the workers are of the first or second categories

35% thirty five percent

The third, fourth and fifth categories of employees

25% twenty five percent

Chemotherapy and hematopoietic stem cell transplantation (myeloablative transplantation)

Oncologists, hematologists, and blood stem cell transplants

65% sixty five percent

Class I or Class II Nursing

55% fifty five percent

Bachelor’s degree in Chemistry, Pharmacology or Biology - Master’s in Immunology and Allergy - Master’s in Molecular Biology or Biotechnology - License or Master’s in Biomedical Sciences - Bachelor’s or Master’s in Psychological Counseling or Psychotherapy

55% fifty five percent

 The rest of the workers are of the first or second categories

35% thirty five percent

The third, fourth and fifth categories of employees

25% twenty five percent

Medical Physics

Bachelor's degree in Physics or Radiation Protection - Master's in Medical Physics

65% sixty five percent

B- Workers in the Radiological Diagnostics Department:

radiographic diagnosis

Diagnostic radiologists

65% sixty five percent

Technical Institute of Radiology or University Degree in Radiological Diagnostics

55% fifty five percent

Class I or Class II Nursing

25% twenty five percent

The rest of the workers are of the first or second categories

25% twenty five percent

The third, fourth and fifth categories of employees

20% twenty percent

C- Employees in other departments:

Other departments in the hospital

Doctors from other specialties

50% fifty percent

Administrators, medical technicians and nurses of the first or second categories

25% twenty five percent

Engineers, maintenance technicians, statistics and computer technicians, and workers in admission offices of the first or second categories

25% twenty five percent

Employees of the third, fourth and fifth categories in the departments

20% twenty percent

Article 2

- Medical staff members shall receive the compensation mentioned in Article 1 of this Legislative Decree during their period of time in the hospital from the hospital budget.

Article 3 -

Postgraduate students and students of specialization (Syrian Board) in the following specializations (radiotherapy, radiodiagnostics, nuclear medicine, chemotherapy, blood stem cell transplantation, tumors, and blood diseases) shall receive a work-type compensation of (35% thirty-five percent). ) on the basis of the lump sum monthly wage on the date of performing the work during the period of their stay in the hospital from the hospital budget.

Article 4

- Those covered by the provisions of this legislative decree do not benefit from the compensation for the nature of work stipulated in Article /98/ of the Basic Law for State Workers No. /50/ of 2004 and its amendments.

Article 5

- A - The period of administrative leave for hospital workers who have direct contact with radioactive sources is six weeks, of which at least two consecutive weeks are granted in both the summer and winter seasons.

 B - The conditions of these leaves, their beneficiaries and their dates are determined by a decision of the general manager of the hospital based on the rules set by the board of directors.

Article 6 –

The provisions of this Legislative Decree shall be applied to departments, centers, divisions or units in public hospitals in the specializations mentioned in Paragraph /a/ of Article 1/ of this Legislative Decree.

Article 7 -

Job descriptions for those who receive the nature of work under the provisions of this Legislative Decree are determined by a decision of the Prime Minister based on the proposal of the relevant ministries.

Article 8 -

Legislative Decree No. /34/ dated 5-9-2012 shall be repealed, and the provisions of Articles (10 and 11) of Law No. /32/ dated 6/19/2006 shall be repealed.

Article 9 -

This legislative decree shall be published in the Official Gazette, and shall be considered effective as of the beginning of the month following the date of its publication.
