Beaches: Procura Genova entrusts the bathing establishment to the Municipality and opens to Bolkestein

The prosecutor of Genoa has decided to entrust the Bagni Liggia, in Sturla, to the Municipality, which will have to publish a tender to entrust them with a public tender as established by the Bolkestein legislation. (HANDLE)


(ANSA) - GENOA, 18 JAN - The prosecutor of Genoa has decided to entrust the Bagni Liggia, in Sturla, to the Municipality, which will have to publish a tender to entrust them with a public tender as established by the Bolkestein legislation.

In recent days, the Public Prosecutor has received and instructed the Port Authority to remove the seals from the bathing establishment to return it to the concessionaire: the Municipality.

This action is intended to make jurisprudence throughout Italy, where according to the investigating judge of Genoa Milena Catalano there are 17594 bathing establishments that do not respect the Bolkestein.


    The news is given by the Genoese chronicle of the Republic. There has been an investigation on Bagni Liggia for four years, starting from an alleged building abuse which then led the prosecutor to investigate the concession and compliance with the Bolkestein legislation. The Council of State has sanctioned the non-extension of the Italian bathing concessions, setting their expiration to 31 December 2023.


    The Attorney General of the Ligurian capital has written to all the other Prosecutors of the Peninsula that have powers on the coasts, lakes and rivers, so that within 6 months verify whether the state-owned concessions of their territory have been assigned with a public tender procedure or have been extended by relying on state laws with which Italy has avoided European regulations for about 10 years.


    Now the municipality should announce the tender. "Let's see what it will do - says the deputy prosecutor Paolo D'Ovidio - but there is no doubt that for the other bathing establishments the same path will have to be followed".


    The lawyer Michele Ciravegna, who defends the manager of the bathroom, Claudio Galli, awaits the events. "Theoretically, the Municipality should follow the instructions of the Public Prosecutor, but there are no criteria for doing so: it will have to wait for the Government to issue a specific provision; or adopt the criteria previously used or those indicated by the Council of State". For the lawyer, however, there is more than one problem: "The Government, after the 2020 formal notice by the European Union, said that the Bolkestein does not apply. It is a paradoxical situation".


    But for the first time the Public Prosecutor orders the release from seizure with a specific purpose: the entrustment to the body for the completion of the tender notice.

The Public Prosecutor has opened a new file on the other managers of the province of Genoa on a complaint presented by Galli.

In the 400 pages he denounced "if I am guilty, that is, not in compliance with the law, then all the others are".

And the judiciary had to open the investigation.
