One day of the trial was not enough to convict an Irschenberger (39) of drug trafficking.

Two witnesses did not appear and the accused remained silent.

– A Irschenberger (39) is accused of several drug offenses, against whom the Miesbach district court is currently being heard.

Since two witnesses did not appear, one day of the trial was not enough to reach a verdict.

According to the indictment, the 39-year-old is said to have traded narcotics in five cases in Miesbach between September 2020 and June 2021.

He is said to have grown two cannabis plants in his apartment in the county seat and on two occasions sold 1.5 grams of marijuana and one gram of amphetamine to a woman.

In addition, the 39-year-old once sold 50 and 20 grams of amphetamine to another unknown person.

Around eight months later, in May 2021, the Irschenberger is said to have sold 50 grams of amphetamine for 550 euros to a Rottacher and in the same period possessed 2.02 grams of hashish and 0.67 grams of marijuana.

On the first day of the trial, however, the accused only confessed to the last allegation in the indictment – ​​that the small amounts of marijuana and hashish were in his possession.

"Yes, that's what I heard, I consume from time to time," the man explained.

However, the fact that the Miesbacher apartment is his own is not true.

"I was only there to work, sometimes I just slept there," said Irschenberger.

Defendant is silent

That was all the defendant wanted to reveal. "I don't want to say anything about the other things," he said. But he did the billing without District Judge Walter Leitner. "The person to whom you allegedly sold the 1.5 grams of marijuana and the gram of amphetamine accepted the penalty order," he said. However, the court waited in vain for a confession regarding this charge. "Have you been drinking?" the prosecutor suddenly asked while glaring reproachfully in the defendant's direction. "Just a cup of coffee with amaretto beforehand," replied Irschenberger. The court then learned no more from him.

It was hoping for a little more from a witness (50) from Miesbach, with whom the accused had occasionally stayed.

He took the wind out of the marijuana-growing charge, saying "I've never seen him grow plants like that."

The district town resident confirmed that the accused occasionally smoked a joint in front of his eyes.

"I don't know whether he also took amphetamine," the witness added.

House search with several drugs found

In any case, during a house search, those 2.02 grams of hashish, 0.67 grams of marijuana and two grams of amphetamine were found in a sink, said an officer (35) from the Miesbach criminal police.

"A witness came to us and informed us about several drug deals by the accused," said the police officer.

Regarding the amphetamine found in the sink, the 35-year-old witness said, "An unknown amount must have been flushed down before we came." Several joints and marijuana-tobacco mixtures were found in the kitchen of the house.

Also in terms of the drug deal - the 50 grams of amphetamine for 550 euros to a Rottacher - he is pretty sure that this took place. "We secured a Telegram chat history between the accused and the buyer," added the police officer. The fact that this deal actually took place could have been confirmed in court by the man whom the police want to have found as the buyer – but he didn't want to and made use of his right to refuse to testify. "I don't say anything about the fact that he should have sold me something in May last year," the Rottacher (27) clarified. "But I already noticed that he consumed it."

Two important witnesses stayed away from the hearing, which is why it has not yet been concluded.

First, the woman who accepted the penalty order.

And on the other hand the witness who is said to have reported to the police about several drug deals by the accused.

At the beginning of February, the process will enter the second round.
