Fürstenfeldbruck – Dangerous bodily harm, that was the charge that was heard on January 18th under Judge Johann Steigmayer at the District Court of Fürstenfeldbruck.

The accused, a 46-year-old from Puchheim, is said to have thrown two chairs at his mother in the shared apartment on October 1, 2019, injuring her in the back of the head and right leg.


The attack was preceded by a dispute about the "transfer of money," the 62-year-old mother told the judge.

Her son, who is currently unemployed, will receive 450 euros from the social welfare office, she explained.

On the day of the incident, she gave him a share of 200 euros, which he could spend on food, cigarettes, but also his child, who he has with his girlfriend.

However, the girlfriend of the 46-year-old called that day and said there was no money to take care of their child.

For this reason, the witness spoke to her son about the money, whereupon the argument developed and he pushed her.


The defendant, on the other hand, asserted that his mother pushed him first and prevented him from leaving the room.

"I didn't touch her," he told the judge.


According to a police officer called at the time, who was also called as a witness, a neighbor had informed the police about the dispute by telephone.

In the report at the time, the mother stated that her son had also hit out with a chair leg and destroyed some drinking glasses.

In court, however, she explained that this should not have been the case.


"Chairs were capable of causing significant damage"

Since the thrown chairs were likely to "cause significant damage," the prosecutor responsible demanded imprisonment. Including another crime for which the defendant was already found guilty in 2021, this should amount to nine months without probation. The called-in public defender, on the other hand, pleaded innocent, after all the case was "a bit foggy". One of the "many uncertainties" he listed was that the mother had spoken to the police about the broken glasses, but revised these statements in court. In addition, their statements contradict each other in the order in which they hit the chair: first foot or head? Or the other way around?


Ultimately, Judge Steigmayer pronounced a suspended sentence of ten months, after all, the court “assumes such disputes are frequent”.

In addition, the accused, who has previous convictions for property damage, fraud, theft and trespassing, must do 200 hours of community service.

In addition, Steigmayer obliged him to move out of the shared apartment and to show a job in three months at the latest.

This is "educationally necessary".
