The Regensburg Regional Court sentenced a 30-year-old to a suspended sentence.

He had attacked a roommate in the asylum accommodation with a screwdriver.

Previously, he himself was the “victim”.

Regensburg – Because he attacked a roommate with a screwdriver in the course of a physical altercation in the summer of 2021, the Regensburg Regional Court* found a 30-year-old guilty of dangerous bodily harm and sentenced him to imprisonment for one year and three months, suspended on probation.

But the case is not as simple as this judgment makes it appear.

That's what Dr.

Michael Hammer, Chairman of the Second Criminal Chamber, in the reasoning clearly.

Judge: Subsequent perpetrator was the victim for months

The peculiarity in this case is that the role of the two parties involved changes depending on the period of time considered.

Looking at the attack alone, the accused Goran K. was the perpetrator and 27-year-old Salar H. the victim.

But if you look back several months, the roles are reversed.

Because the attack has a history in which Salar H. insulted, humiliated and mocked the now convicted for months.

The court firmly believes that Salar H. secretly filmed his roommate as he masturbated.

He then participated in the distribution of the video recordings.

It not only circulated in the refugee shelter where the two live, but was also sent to the family of Goran K. and his fiancée in Kurdistan (we reported).

After many humiliations Goran K. burst the collar

For the very religious Goran K. this was a particular shame.

His family is said to have not only wished him dead, but even threatened to kill him himself.

When the family breakup was discussed in the courtroom, Goran K wept. The public prosecutor's office is now investigating Salar H. because of the video.

According to the conviction of the court, the latter repeatedly provoked the accused for months.

On the evening of the crime, too, he sat in a beer and shisha group in front of the accommodation and sang songs in which he despised K. with reference to the video recordings.

Since Goran K. burst the collar.

He went down the outside stairs of the accommodation, insulted H. and attacked him.

Others present intervened and separated the two opponents.

But there was another collision.

The almost blind Goran K. pulled the screwdriver to defend himself against the superior opponent.

He sustained only minor injuries.

A roommate intervened, took the screwdriver away from the attacker and called the police.

None of those present could really observe the screwdriver attack itself.

Salar H. was only slightly injured.

Accused claims: "I was only defending myself"

The accused protested his innocence in a last word. He was just defending himself. "I'm ready to swear. God is my witness.” Defense attorney Julian Wunderlich also pleads for acquittal and describes his client as a “classic victim of bullying”. Wunderlich focuses in particular on the fact that Goran K. is almost blind and is therefore clearly inferior to his opponent. The idea that K. stabbed the "overpowering attacker" H. and even dragged him across the floor - as the indictment says - "goes too far," according to the defense attorney. But he failed to convince the court.




However, the chamber is not able to identify attempted manslaughter, as charged by the public prosecutor.

Targeted stabs against the neck, as Salar H. later described and also believed by the public prosecutor's office, could therefore not be proven beyond a doubt - especially because the chamber classified Salar H. as a rather half-silk person and an overall implausible witness.

Judge shows sympathy for the accused

In any case, a qualitative difference can be seen in the changing perpetrator-victim relationship: "Salar H.'s wounds have already healed, the wounds of the accused may never heal," said Judge Hammer.



Goran K., who was in custody or accommodation for seven months before the trial, is now free again.

His probationary period is three years.
