The Rouen Court of Appeal will rule on February 3 on the Balkany couple's appeal against the revocation of their placement under an electronic bracelet, a sentence adjustment measure which had allowed them to avoid prison, AFP learned. Monday, January 24 from a judicial source.

A hearing before the sentencing chamber was held Monday morning to examine the decision of a judge in Évreux to suspend their placement under a bracelet.

If the appeal of the Balkany spouses is rejected on February 3, the couple could then be the subject of a warrant of deposit.

A hundred incidents related to the bracelet

Asked by AFP, Isabelle Balkany's lawyer, Pierre-Olivier Sur, refused to speak.

According to Médiapart, the Balkany couple's placement under an electronic bracelet in order to serve their conviction for tax evasion was revoked on December 17, during a hearing at the Evreux sentencing court, after a hundred incidents.

The Balkany spouses had appealed, thus avoiding incarceration.

The couple was sentenced on appeal in March 2020 to three years in prison for tax evasion.

Following this conviction on appeal, Patrick and Isabelle Balkany, aged 73 and 74 respectively, were dismissed from their elected offices.

They were then mayor LR and first deputy of Levallois-Perret (Hauts-de-Seine).

Incarcerated at the end of 2019 at the Health prison in this case, Patrick Balkany was released 5 months later for health reasons.

In application of these sentences, the Balkany spouses had been placed at the beginning of 2021 under an electronic bracelet in their property of the Cossy mill, in Giverny (Eure), with exit times.
