After the 2020 Legislative Council General Election, the Independent Commission Against Corruption today (25th) charged two candidates from the New Territories West geographical constituency, Zhao Baoqin and Wang Zhenlin, both on the same list, for allegedly failing to comply with the provisions of the Election (Corrupt and Illegal Conduct) Ordinance Submit an election return.


Zhao Baoqin will appear in the Kwun Tong Magistrates' Court today (25th) afternoon, and Wang Zhenlin will appear in the same court on Friday (28th).

The defendants, Zhao Baoqin (47 years old), a nurse, and Wang Zhenlin (41 years old), a bus driver, are also charged with one count of failing to violate the Election (Corrupt and Illegal Conduct) Ordinance in accordance with Section 37 of the Election (Corrupt and Illegal Conduct) Ordinance. The election was originally scheduled for September 6, 2020.

The Registration and Electoral Office has received two nomination forms for the New Territories West geographical constituency during the nomination period from 18 to 31 July 2020.

Zhao Baoqin and Wang Zhenlin are the first and second candidates on the nomination list respectively.

The ICAC stated that the election was subsequently adjourned in accordance with the Emergency (Date of General Election) (Seventh Legislative Council) Regulation which came into effect on 1 August 2020.

According to the Regulation, the Elections (Corrupt and Illegal Conduct) Ordinance applies to the election and "candidates must ensure that their election returns are filed before the expiry of the 60-day period commencing on 1 August 2020." The statutory deadline for candidates to submit election returns to the REO is 29 September 2020.

The charge alleges that on September 29, 2020, Zhao Baoqin and Wang Zhenlin, as candidates on the same nomination list for the above-mentioned election of the New Territories West geographical constituency, failed to submit election returns as required.

The Registration and Electoral Office provides comprehensive assistance during the investigation of the case by the ICAC.
