"All Cops Are...": Defense attorney with curious explanation for verbal slip - judge not convinced

At a Corona demo, a Eurasburger (24) is said to have insulted a police officer.

But when they heard the phrase "ACAB" ("All Cops Are Bastards") passing by, the fun ended for a police officer and her colleagues. A 24-year-old from Eurasburg had to answer before the Wolfratshausen district court for insult in two cases: he was sentenced to a fine of 3,000 euros.
The event was coming to an end when the incident happened.
The visitors were once again advised to wear a mouth and nose protector when leaving the site, said the official as a witness, who was supposed to ensure compliance with the Corona rules with her colleague.
Because a girl wore her mask "at half mast", she was asked to "put it on properly", the police officer explained.
Shortly thereafter, the saying "in our direction" fell, the second official recalled.

The participant to whom they had assigned the insulting phrase initially apologized, but at the same time pointed out that "ACAB" - the phrase that causes a kind of allergic reaction in every law enforcement officer - according to various court decisions is no longer an insult. Some time later, in a written statement on the allegations, the defendant said he didn't want to hear anything more about it.
The accused himself did not comment on the allegations during the hearing.
His father, who said he walked just behind his son as he left the fairground, said he overheard the policeman accusing his son of insulting him.
However, he himself did not hear any insult.
"We were completely amazed at what happened there," said the 56-year-old.
"To my mind, it was all very strange." The defendant's girlfriend, who had been called by the defense as another witness, made a similar statement.

Because these two people, who were standing in close proximity to the incident, had not heard anything, she was convinced her client should be acquitted, said defense attorney Daniela Gabler, who presented the court with her own interpretation of the acronym ACAB: "All Cops Are Beautiful".
In addition, police officers are no better witnesses than others.
"It's not like Schafkopf: Ober beats Unter," said the lawyer, who concluded: "What we have is not enough to convict him."

The court saw it differently. "It would have looked good on you if you had apologized," Judge Helmut Berger told the accused after he had sentenced him to a fine of 60 daily rates of 50 euros each. For him, the police officer's detailed descriptions gave a coherent picture. "Why would he go into so much detail if he's just trying to blackmail her?" asked the judge. According to Berger, he does not believe that the officer pulled the 25-year-old out of the crowd for no reason to want to do some work. He made the accused understand: "The statement was completely meaningless." (rst)
