A 66-year-old accused in connection with the murder of the Kassel district president Walter Lübcke has been cleared of the suspicion of negligent homicide.

In its judgment on Wednesday, the Paderborn district court did not see it as proven that he had sold the murder weapon to the right-wing extremist and Lübke's later murderer Stephan Ernst.

Paderborn - Both the public prosecutor's office and the defense pleaded for acquittal on the main charge on Wednesday.

Rather, all indications that Ernst is said to have illegally acquired the murder weapon and ammunition from the accused in 2019 came from Ernst himself, the judges reasoned.

He was not credible as a witness.

Because the judgment against him was not yet final, Ernst had referred to his right to refuse to testify and had not even been invited to Paderborn to testify.

In its indictment, the public prosecutor's office assumed that the man from Borgentreich in East Westphalia had negligently caused Lübke's death by selling weapons.

The defendant denied selling the guns at the trial and only admitted to having done business with Ernst and having illegally owned firearm ammunition.

He was therefore sentenced to a fine of 1,350 euros for violating the Weapons Act.
