Federal Constitutional Court: AfD fails with lawsuit against 2G

The Federal Constitutional Court has rejected an application by the AfD parliamentary group against the 2G Plus regulation in the Bundestag. There was no "serious disadvantage" for the deputies.

The AfD has lost its lawsuit against the 2G Plus regulation in the Bundestag before the Federal Constitutional Court.

The Karlsruhe judges wrote in the decision issued on Wednesday that the application was "inadmissible" because it did not provide sufficient reasons for the fact that the disputed regulation threatened a "severe disadvantage".

The AfD had requested an interim order from the court to allow unvaccinated MPs access to the Bundestag's Holocaust memorial ceremony on Thursday.

According to the specifications of the Bundestag Presidium, only demonstrably vaccinated or recovered MPs may take part in the commemoration in the plenary session.

MPs who do not meet these requirements are not allowed to take part in the event - not even in the visitors' gallery.

The affected AfD MPs saw their opposition rights violated.

Unvaccinated MPs are allowed to attend the regular plenary sessions of Parliament from the stands.

According to the specifications of the Bundestag Presidium, this regulation does not apply to other events such as commemorations.
