New York (CNN Business) --

A Manhattan restaurant where Sarah Palin was seen dining indoors while unvaccinated over the weekend confirmed the former Alaska governor returned to the restaurant, this time dining outdoors on Wednesday, just days after testing positive for Covid-19.

At issue is current local guidance advising people who have tested positive to remain in isolation for five days after their test.

"Our goal has always been to encourage isolation for those who test positive for COVID and provide them with multiple resources," said a spokesman for the New York City Council.

"That said, we expect anyone with COVID to self-isolate for their own safety and the safety of all New Yorkers, and we find it highly irresponsible that Sarah Palin refuses to do so."

Palin, who is in Manhattan for her libel trial against The New York Times, tested positive for covid-19, the federal judge presiding over her case reported Monday, delaying the start of the trial.

The day Palin first tested positive is unclear.

"She, of course, is not vaccinated," District Judge Jed Rakoff said Monday, according to Reuters.

CNN has contacted an attorney for Palin for comment.

Luca Guaitolini, manager of Elio's restaurant, confirmed to CNN that Palin dined at the restaurant again, this time outdoors.

"Sarah Palin returned to the restaurant tonight to apologize for the altercation from her previous visit. In accordance with the vaccination mandate and to protect our staff, we seated her outdoors... We are a restaurant open to the public and treat civilians the same way," Guaitolini said.

CNN asked Guaitolini to comment on why Palin was allowed to dine at the restaurant two days after a judge announced her positive test result.

On Monday, a spokesman for Mayor Eric Adams said the rules about being vaccinated for indoor dining were put in place to protect all New Yorkers.

"Ms. Palin has to respect small business workers and follow the rules like everyone else," the spokesman said in a statement Monday.
