Judge Manuel García-Castellón considers the investigation of

the Dina case finished

and, in the absence of making three statements that had already been approved, it has refused to extend the investigation period. The magistrate makes this decision after finding no evidence of an alleged crime of computer damage committed by Pablo Iglesias, former secretary general of Podemos, since the Police have sent him a report explaining that he cannot clarify why the phone card does not work of Dina Bousselham, one of her former advisers, who reported the theft of her mobile in 2015 and whose content was found copied at the home of commissioner José Manuel Villarejo and also ended up published in various media. The judge maintained that the politician had harmed her.

García-Castellón, who targeted Pablo Iglesias in 2020, was waiting for said report from the Scientific Police. He commissioned it after the Supreme Court refused to charge the then leader of Podemos and returned the case due to lack of evidence. According to the magistrate's theory, the former Vice President of the Government had received Bousselham's card in January 2016 from the president of Grupo Zeta, editor of the defunct magazine

Interviú

, and "kept it without telling its owner." Then, according to his thesis, the political leader damaged the device and, as a result of the copy of the content being published in various media, he devised a plan with the aim of taking advantage of the judicial investigation to invent a conspiracy and present himself as a victim.

In the letter that he sent to the Supreme Court to charge Iglesias, the magistrate already stated that "there is no direct proof of the material destruction of the card by" the politician, but added that he presents an internal "ruling" that he attributes to him . Hence, he commissioned this latest report from the Police to try to find out the causes that prevent access to the device.

Once the conclusions of the agents have been received, the judge has issued an order this Thursday to end the investigations.

As stated in its resolution, "the need for any subsequent diligence arising from the report does not emerge."

In addition, the magistrate adds that he will not need to practice more evidence derived from the interrogations that are pending and ordered by the Criminal Chamber of the National Court: that of Dina Bousselham herself and her partner;

and that of Eugenio Pino, former Deputy Director of Operations of the Police, who was set to try to clarify whether Villarejo informed his superiors that he had a copy of the Iglesias adviser's cell phone.

The report of the Scientific Police on the card, to which EL PAÍS has had access, concludes that neither the causes nor the moment in which the card was damaged can be determined.

Nor has it been possible to determine the date of the last time its content was accessed, nor has it been possible to retrieve information on the modification, creation or deletion of the files that "were stored in memory at the time".

According to the researchers, the device presents irreparable "damage" and, "of the two 16-

crystals that make up the memory, only one of them has been accessed", but its content cannot be decoded.
