There was a lot of excitement on Thursday evening in the Murnau municipal council: it was discussed that the citizens' forum had published content from a non-public session on Facebook in December.

However, the elected officials refrained from a fine or a complaint.

– Wolfgang Köglmayr (More Moving) has been a member of the Murnau municipal council since 1984, with a six-year break.

But he has never experienced anything like this.

Contents of a non-public session leaked out.

"The duty of confidentiality has been violated." Köglmayr was "shaken" on Thursday evening in the market town council.

And he wasn't alone in that.

There were comments like "Unding" (Dr. Michael Rapp/CSU), "damage to trust" (Phillip Zoepf/More moving), "severe violation" (Maria Schägger/Freie Wahler) or "breach of trust" (Dr. Elisabeth Tworek/More Move).

What happened?

At the end of last year, at the suggestion of Felix Burger (SPD), a working group with several council members dealt with how to formulate a vaccination appeal.

After some back and forth, a text was agreed.

But this was apparently dismantled and torn in a non-public council meeting.

Two lines remained.

The ÖDP/Bürgerforum did not like this.

As a result, the draft of the ÖDP/citizens' forum was published on the Facebook page of the citizens' forum, along with an accompanying text stating that the local council did not approve of the working group's draft and that the vaccination appeal was limited to two lines.

"In front of a global audience"

On Thursday, the market town council received an application from the CSU, More Move, Free Voters and SPD for violating the duty of confidentiality. "Something like this mustn't happen again and should never have happened," emphasized Köglmayr. CSU parliamentary group spokesman Rudolf Utzschneider complained that the violation had happened "in front of a global audience". He would also have expected more commitment from City Hall boss Rolf Beuting (ÖDP/Bürgerforum) in the matter. Tworek was also displeased: "A good idea was totally frayed and one party took advantage of it."

Beuting explained that after he found out about the matter, he "immediately complained" about the incident to the ÖDP/Bürgerforum parliamentary group.

They immediately deleted the post.

Apparently the post was visible for two/three days.

According to Beuting, parliamentary group spokesman Michael Manlik then sent an e-mail to the municipal council, acknowledging the misconduct and apologizing.

"This is an important first step," said Beuting, underlining: "Non-public should remain non-public."

Manlik took responsibility for the mistake on Thursday and apologized.

"It was an offence." However, Manlik apparently did not post the post.

His group colleague Wolfgang Küpper said that "the one who posts is not part of the group".

The accompanying text with the information on the closed session "was never intended for publication".

It was not the group's intention to cause distrust.

When asked by the Tagblatt, Küpper did not want to reveal the name of the person posting on Facebook for the citizens' forum.

Raab can't see any problem

Josef Raab (Bündnis 90/Die Grünen) couldn't understand all the excitement.

“What is secret about the fact that a municipal council is discussing Corona and a vaccination recommendation?

I can't see any problem there at all.” Raab spoke of a “culture of excitement”.

He thought: "We shouldn't also contribute to that." Zoepf replied: "Everyone on the committee assumed that it was not public."

The municipal council could now have imposed a fine or issued a reprimand.

However, since Manlik was obviously not personally responsible for the post, the panel refrained from doing so.

But why was the vaccination appeal dealt with behind closed doors at all?

City hall spokeswoman Annika Röttinger: "This topic was dealt with for the first time in the main administrative committee meeting on December 9, 2021 under the agenda item inquiries and announcements in the non-public part." In the area of ​​inquiries, it is up to each municipal council member to make them public or private would like.

The inquiries were not known to the administration in advance.

"In the municipal council meeting on December 16, 2021, the possible vaccination appeal was then dealt with again under the item inquiries and announcements in the non-public part." Incidentally, the appeal was never published.

The publication was stopped by the administration on December 20 after the incident at the request of the factions.

Criticism from the community day

Criticism comes from the Bavarian community day.

Press spokesman Wilfried Schober explains that the normal case is the public meeting.

“Only topics that require secrecy or are relevant to data protection must go to a non-public meeting.

The discussion about a call to be vaccinated does not need to be kept secret or relevant to data protection. ”Therefore, according to Schober, there is no reason to conduct it behind closed doors.
