After a spray gun dispute in the outdoor pool, a convicted Hartz IV recipient was again before the Ebersberg district court.

Due to extraordinary circumstances, he had not been able to serve his sentence.

Ebersberg – This is how you see each other again: Judge Vera Hörauf met a familiar face in the Ebersberg district court.

The 39-year-old from Wasserburger was already in the dock at the beginning of July 2021 – because of a dispute with a woman and her child in the Grafinger outdoor pool.

At that time it was about a water pistol made of foam rubber, which the Wasserburger is said to have thrown angrily at his son and racially insulted the woman.

At the time, the man admitted that he was angry, but there was no risk of injury from the water spray.

Because of the insult, the job seeker was sentenced to pay 200 euros to an association for the support of children with cancer and the physically disabled.

However, the Wasserburger did not pay for it.

That's why there was another trial for dangerous bodily harm, including the witness' arrival.

But even before the public prosecutor's office could read out the charge, the defendant's public defender intervened.

He explained that the man from Wasserburger had suffered an intestinal perforation in the same month.

The result was an emergency operation.

Since then, the Hartz IV recipient has spent most of his time in the hospital.

In addition, he needed his scarce money for the medication after the operation, the accused added tearfully and gratefully accepted a handkerchief that Richerin Hörauf handed him.

Since the illness he has been doing badly, he is still overwhelmed with his personal situation: "The fact that I bring the children to the kindergarten and pick them up is the only thing I can do," says the man.

Accordingly, he paid little heed to the court's payment reminders.

The defense attorney suggested that the case be dropped, the accused would soon pay, and if allowed, he would also advance the money to the accused.

The accused gratefully accepted this offer and assured his lawyer: "On the 31st, when I get my money, I'll transfer it to you." The case was dropped.
