Defendant Lau Si Wai (27 years old), was convicted of one count of possession of a tool fit for an unlawful purpose and two counts of theft. The charge alleges that on November 18, 2019, he was on the flyover of Hung Hom Railway Station near Exit A1, with possession of 1 set of hexagonal spoons, 4 scissors and 1 knife with intent to use for illegal purposes; and 2 membership cards of the Hong Kong Archery Association were stolen from PolyU from 12 to 18 of the same month.
Magistrate Liang Yaxin revealed at the time of sentencing that the probation officer reported that the defendant had regretted it, but he was convicted after trial. His remorse came too late and his help was limited. Considering that the six-pointed key found on the defendant was still in the package, it was accepted that he should not have any. However, the situation at PolyU was serious at the time, with many violent acts and damages. The defendant came out of PolyU and hid scissors and knives, etc. In addition, he stole 2 other people's membership cards in order to use the identity of others to enter and leave. PolyU campus, 7 months in prison for 3 charges.
During the interrogation, the defendant revealed that he entered PolyU on November 14, 4 days before his arrest. He originally supported "He Lifei". Later, when he saw some demonstrators cutting trees and making arrows, he was afraid and planned to leave, but I saw someone entering the campus with a hammer and turned it around.
He also said that the six-point key was used when preparing to ride a bicycle. He also said that there were protesters setting up a customs-like checkpoint at PolyU at that time, and he wanted to use the two membership cards to disguise himself as a student.
However, he later changed his tune and said that after finding it, he planned to leave PolyU and hand it over to the police.
However, the magistrate believed that his statements were contradictory and unreasonable. He also pointed out that he could have left the scene early, but he still stayed.
