The TSJC orders the Cardedeu City Council to replace the Catalan and Spanish flags

The Superior Court of Justice of Catalonia (TSJC) has ordered the City Council of Cardedeu (Barcelona), governed by the ERC and the CUP, to replace the Catalan and Spanish flags on the façade of the building, where now only one estelada is displayed.

The consistory is studying the resolution and affirms that it will not make any decision until shortly before the deadline to appeal this judicial decision expires on March 10, according to what municipal sources have indicated to Efe.

In the sentence, the fifth section of the contentious administrative chamber of the Catalan high court revokes the decision of the contentious court number 5 of Barcelona to dismiss the Citizen Impulse lawsuit and orders the Cardedeu town hall to replace both the Catalan flag and the Spanish.

The Cardedeu City Council, led by the Republican mayor Enric Olivé, who governs in coalition with the CUP, removed the Catalan and Spanish flags from the municipal façade years ago, where only a pro-independence flag is now displayed, which for months it also accompanied a banner in support of the prisoners of the

The Asociación Impulso Ciudadano took the case to court after verifying in October 2020 that neither the flag of Spain nor that of Catalonia was waving on the facade of the town hall, without any agreement of the municipal plenary endorsing this decision.

The association appealed to the courts, considering that the council had taken the de facto route to remove the official flags of Spain and Catalonia and to request that their replacement be ordered.

The Cardedeu City Council argued that the Asociación Impulso Ciudadano was private and that it was not entitled to make this request, since it did not prove a legitimate interest and, therefore, could not be recognized as a controller of legality.

Despite the fact that initially the contentious court number 5 of Barcelona agreed with the City Council and filed the case, the Association appealed to the TSJC, which has now determined that this entity is entitled to intervene in this process because it sees consistency between its purposes, based in the defense of constitutional values, and the object of the procedure.

In addition, the TSJC has accepted the precautionary measures requested by the Association so that the flags of Spain and Catalonia are replaced outside the town hall, because they were removed "in fact" and also the City Council has not highlighted in the process "no reason" that implies a possible "disturbance" of the general interests or of third parties if both banners were hung again.

In a statement, Impulso Ciudadano has celebrated this resolution and recalled that last November it presented a report detailing that of the 947 municipalities of Catalonia, only 149 waved the Spanish flag and that 392 did not display the Catalan one.

Impulso Ciudadano considers that the TSJC has endorsed its decision to resort to justice, for which it has announced that in the coming days it will require the municipalities that do not display the official flags to "regularize" their situation regarding the presence of constitutional symbols and statutory.
