The 90-day rule for those who have recovered remains politically explosive.

The Robert Koch Institute had introduced them - but will probably not be allowed to take such steps in the future.

Berlin – The shortening of the convalescent status caused a stir in January.

Almost overnight, millions of people lost their recovered or vaccinated status.

Because there were also new rules for Johnson & Johnson vaccinated people.

The irritation was great, the opposition violently attacked Health Minister Karl Lauterbach (SPD).

After all, he made the adjustment possible in the first place - and thus helped the Robert Koch Institute (RKI) to make decisions about the recovered status.

That should now change again.

The reason for the intervention of the federal and state governments is the Federal Council meeting on January 14th.

Actually, the Bundesrat should vote on the new Corona regulation.

It resulted from the summit resolutions of January 7th.

Explosive: In that MPK there was no resolution in the direction of the 90-day rule.

It was Lauterbach who set the course for adjustment in the plenum.

As a representative of the cabinet, he advocated that in future it would no longer be the parliament that should decide on the validity of the convalescent status, but rather the Paul Ehrlich Institute and the Robert Koch Institute.

Both are federal agencies under the jurisdiction of the Department of Health.

Lauterbach spoke in the Federal Council of a "good solution" because one could react "quickly".

Lauterbach did not mention that there could be an additional shortening of the convalescent status.

The next day, the 90-day rule could finally be read on the RKI website.

Bundestag experts also expressed fundamental doubts about the decision-making power of the RKI.

In one individual case, a court even reversed the decision.

Corona recovery status: Wieler under pressure – the 90-day rule has already been overturned by the courts

The adjustment came as a surprise to many observers.

A reduction in the convalescent status was almost never an issue before, especially since much more generous rules apply in Europe.

Across the EU, people are considered recovered for six months, in Switzerland even twelve.

The RKI around President Lothar Wieler found it difficult to explain.

In the meantime, Wieler's personal details have even become a political issue - even within the federal government.

The FDP counted the RKI boss publicly, Lauterbach had to settle.

Lauterbach himself found himself caught in the crossfire.

The minister claimed not to have known anything about the rapid adjustment.

"I was asked, 'When will the recovered status change?'

not included, ”said Lauterbach at the federal press conference.

That is at least surprising, since the RKI is actually in constant contact with the ministry, as the authority itself reports on request.

It is still unclear what the decision for the convalescent status means.

Another court recently overturned the 90-day rule, this time in Bavaria.

However, the judgments always relate only to the individual plaintiff.

A nationwide regulation is still missing.

If it is to be worked out in the near future, according to the draft resolution, the RKI will no longer make the decision.
