The Independent Commission Against Corruption (ICAC) yesterday (14th) charged a former "foreman", a sub-contractor of a public housing construction project in Tung Chung, for allegedly receiving illegal rebates totaling about 18,000 yuan from four workers to help them get hired and paid .


After receiving a corruption complaint earlier, the ICAC launched an investigation. After completing the investigation, it sought legal advice from the Department of Justice, and charged the former "foreman" in accordance with the relevant legal advice.


The foreman of the site involved, Chen Zhiqiang, aged 57, was formerly the "foreman" of the subcontractor Huiji Construction Engineering Co., Ltd.

Chan is charged with seven counts, namely two counts of conspiracy to cause an agent to accept an advantage, contrary to Section 9(1)(a) of the Prevention of Bribery Ordinance and Section 159A of the Crimes Ordinance; and five counts of accepting an advantage by an agent , contrary to section 9(1)(a) of the Prevention of Bribery Ordinance.

The accused has been released on ICAC bail pending his plea in the West Kowloon Magistrates' Courts tomorrow (February 16).

The foreman asks the carpenter for a daily rebate of 100 yuan

At the time of the incident, Huiji was a subcontractor for a construction project in a public housing estate in Tung Chung, and carried out carpentry works on the site.

The defendant was the "foreman" of Huiji, the company recruited woodworkers through employee introductions.

The case occurred from October 2019 to February 2020. The defendant had introduced four carpentry workers to work on the site and were employed by Huiji with a total daily salary and bonus of $1,250.

Two of the charges allege that the defendant is suspected of conspiring with two of the above-mentioned workers to make the defendant accept an illegal rebate of RMB 100 per working day without legal authority or reasonable excuse, as the defendant assisting the two Incentives or remuneration for hiring and continuing to be employed by Huiji.

The defendant is suspected of receiving illegal rebates totaling $8,300 from the two.

The other five charges allege that the defendant, without lawful authority or reasonable excuse, accepted illegal rebates totaling $8,800 and $500 respectively from the remaining two workers, as the defendant assisting the two in their employment and continued employment, or issuing Huiji Incentive or reward for a paycheck to one of them.

The ICAC pointed out that workers in the construction industry should report illegal rebates.
