In November 2019, in an "Operation Dawn", a female college student was accused of "robbery" pulling the arm of a black woman who was subdued by a police officer. The female college student was convicted of obstructing a police officer and sentenced to 3 months in prison .
She refused to accept the ruling and filed an appeal in the High Court today (23rd), saying that when the police officer gave evidence, he pointed out that the hair color of the subdued person was blond.
The prosecution, however, countered that the police also described other characteristics of the subdued person, which did not have a critical impact on their evidence.
The judge adjourned the case until March 25, and the appellant remained on bail.
The appellant, Lau Shimin, was found to have deliberately obstructed the riot police officer Cheung Tak Chun, who was performing his duties properly, outside Exit A of Tseung Kwan O MTR Station on November 14, 2019.
Refers to the person being subdued with non-blond hair
The barrister representing the appellant disputed whether the act of blocking the office in the case was made by Liu.
The barrister pointed out that the police officer involved said that the person he was chasing had blond hair, but the person who was subdued was not blond. He questioned the police officer's misremembering and believed that his evidence was not reliable.
Prosecution alleges robbery
However, the representative of the Department of Justice countered that when the police officers identified the pursued persons, in addition to mentioning their hair color, they also described other characteristics. They believed that the difference in hair color alone did not have a critical impact on their evidence.
The Department of Justice also pointed out that the case involved "robbery", and the three-month prison sentence was not obviously excessive.
